CVI Countersues Acacia - Seeks Class Action
Just saw this on www.allofem.com:
Cybernet Ventures, parent company of Adult Check, has filed a countersuit and class action suit against Acacia. The suit in part responds to Acacia's claim by detailing instance by instance that they "deny each and every allegation contained in the Complaint". In the counterclaim Cybernet "seeks a declaratory judgement of invalidity, noninfringement and unenforaciblity" on Acacia's streaming media patents. http://www.allofem.com/CybernetAcacia1.pdf I believe the "class action" part just pertains the group of defendants sharing the same liabilities. Cybernet does demand a jury trial, denies all liability for infringments and sets forth 15 affirmative defenses. The counterclaims are pretty much pro-forma. You have to assert any counterclaims in your Answer, or else waive them. These can be amended later. Basically, Cybernet is asking for equitable relief from further harrassment, attorneys fees, and any other equitable remedies deemed fit by a judge or jury. However, attorney's fees and costs could run quite high in a case like this |

Did anyone read the PDF?
the Fifth Affirmative Defense says that Acacia had their claims of one of their main patents (the '902 one) checked by a research company. The company made a report that basically said that the patent is _NOT_ novel. They had 28 references to stuff that talked about the same ideas. Most of them dated BEFORE the date on the 902 patent! They did not include that report when submitting it to the PTO... very interesting.. (hope I didn't misunderstand) |

Did you see where Acacia was doing a $50m shelf offering to raise cash. What happened to the $40m+ cash on hand they had last quarter? Can't wait to see the quarterly report.
