am I getting ripped off?
 
I wrote this guy a check to use his apartment the other day for a shoot, for $200.

Guy calls 2 days later to say he lost the check, and wants me to reissue it. I reissued the check after putting a stop payment on the first one, for $185

Guy calls 24 hours later to say he lost the second check, so I deduct the $30 stop-payment fees and I write him a third, for $170.

Checked my bank account today, and to my suprize I see the $185 check has cleared. I call him to ask him for the third check back, and he says he never cashed the second one and it must have gotten stolen.

I called the bank a few minutes ago and had a stop-payment put on the third check, so I'm not getting taken for $355, but I guess it comes down to this. No matter what the check says, it's going to have someone's signature with his name. I can't tell what's what, and I can't tell who's bank account it actually went into. I also don't know if he may have given the check to a friend, to split it with. Should I hold him liable for the lost check? I don't see any alternative at this point.

yeah, sorry Noah, I think you got had. If I had lost the second check I would just let you use the house on the basis that I was a tool and lost two checks. You should be able to see who cashed the check though, and if it was him take him to small claims court, if it wasn't, take him anyway, he lost it and it cost you money, he should help you out for free.

I never stopped the payment on the second one, and that's the one that cleared. Is there any recourse through the bank for me to get the money back?

It's really hard for me to call this guy out on this. Really really hard. I can't tell if he's being honest with me or not, he pleads with me on the phone that somehow someone else got the check, and he's not the one that cashed it.

It's a tough situation, but I'm not going to be losing money due to his mistake. He says I need to make good on the third check, because he doesn't think it's fair that he's not going to be able to make rent without it, and it's going to cause checks to bounce on his end.

Lost the check twice? He is ripping you off. File a police report, they will get the check and will see if it is his signature or not. Then you can file Fraud charges against him and he will get to visit the Grey Bar Motel.

It happening with one check I can see but 3 times and he ends up cashing the 2nd one. Shit!
