Is it possible to trademark a name (domain),a logo etc. without owning the domain?

I have received on offer on a domain by someone that says they own the trademark on the domain, the name and the logo.

Is that possible?

I am going to get a trademark in South Africa on gofuckyourself.com and get the domain name from Lensman in court.
I am offering pre-paid advertising opportunities.

Anything is possible, but it sounds like bullshit. How can they have a trademark on your logo?

Mate it all depends on the circumstances and what the name is.Whether its a generic domain or such.There is no set rule and alot is decided in court if it ever gets that far.If you want to keep the domain then you may have a good chance.If you want to sell it to them ask for heaps as it will probably cost them a fortune in legal fees to try and get the name off you.

The domain is cashtools.com, I registered it with plans to do something with it but I can't find the time. So I would sell it if I can get a nice offer. Now somebody wants to buy it and they say they have trademarked cashtools.com and the logo (?).

They say there lawyer will get on everybody that uses the domain in America.

Is this possible? Since I am willing to sell it, what should I ask? Should I tell other interested people about the trademark thing?

There are several people that would know. They call themselves lawyers. When the GFY people that work at Burger King get off, they'll come in and play lawyer for you.

Do a trademark search or ask the person to provide proof of the trademark. Sounds like the person is saying that to get you to sell the domain name real cheap or for free.

And when do the BK shifts end? I asked my lawyer but he could not give a clear answer since he isn't specialized in this subject and he had to do the evening Mcd's shift
