I think the FTC bounty program is supposed to be put in place by the end of this year. It's been said that it will offer 20% of the penalties collected to the person providing information to the FTC. The CAN-SPAM law allows for fines up to $6,000,000 USD With one referral most people could retire.... So are you going to sign up for this hot new referral program? :glugglug |

I wonder how crazy this is going to get though.
Back in the witch hunt days, they basically labeled people as witch or sorcerer so that they could kill them and take their land and money. Friends and neighbors of these "witches", either stricken by poverty or greed would turn them in for similar commissions. :) Corporations with money could easily be set up by employees wanting to cash in. Will that be a valid excuse to get off the hook? "One of our employees did it without our knowledge or consent..." I guess it will depend on who you are. |

The major problem is that they will revert back to the witch hunt days in the trials..
In salem someone would accuse a person of being a witch and they would take the person into custody. to find out if they were guilty or not that would dunk them into water or burn them at the stake. If they lived, they were a witch and there fore put to death. If they died, then they were innocent. Same thing will happen here.. There are programmers that are so good that they will be able to cover their tracks, and put the blame on someone else. That person most likely will not have the money to defend them selves, and end up screwed... |

By doing so, we ensure that people sue with care and intelligently because I dont know of anyone that runs off to the bank for certified checks in the amounts of $100 or thereabouts for a filing fee just for the hell of it. Nearly every state law allowed a private right of action against the sender for presumptive damages and furthermore made the process easier by not requiring the plaintiff to prove actual damages took place, only that the defendant engaged in the unlawful conduct. The CAN-SPAM Act is a horrible piece of legislation that hopefully will be nullified by the appeals courts since Congress no longer represents the people. It takes away the right of private action against the spammers. |

It is kind of witch-hunt scary though...
It would be fairly easy to frame someone they don't like as a spammer & try to collect the bounty. Espeically when you consider that half the people on the internet are infected with various viruses. I have a feeling it wont be a free for all kind of program though... you'll probably have to jump through some hoops, register & qualify as a bounty hunter. |
