I wrote an article a while back that might help -
http://ynotnews.ynotmasters.com/issu...402/page5.html I have found that the hosts are willing to help if they're not too small. Also, follow up with their payment processor as well. |
Get a lawyer, start with the C&D, move to threats of law suit,
sue the bastard. Judges are educated well and can see a thief as a thief. |
This is what you do, at least what I know works the best.
Unless you have the stuff formally copyrighted (and it truely does not sound like you have), forget about lawyers, you won't recoup whatever it costs you, far from. Take some screenshots and have someone else take a look at it so you actually have a few witnesses (some of those fuckers might change the files (and keep the filenames) and in worst case they could actually sue you for false claims. Instead of sending a DMCA to his host you send it to his billing company. They are obliged to react (and they will). If the guy does not react soon (72 hours normally), the billing company will normally freeze the account and not process sign ups nor rebills. If it's repeating infringement, they might actually close his account. This is by far the most effective way to handle these bastards, as you might actually hurt their income if they don't react fast! :) V |
forget the C&D, forget squealing to the processor. Go to your courthouse and file a theft complaint. Take them to court and sue them for copyright infringement and theft. Don't give them a chance to get out of it. Bust them while you can. Any damage to a competitor is good damage. :2 cents:
They knew what they were doing. So why treat them with kid gloves. Knock 'em out. |
If they have money go for the juglar first. No warning file a law suit in Federal court serve their ass and wait until they contact you about settlement. Make sure you have copies of the site as it infringes upon you. If they have no money then simply send a C&D to their host. The host is not laible without this step.
