Mitchell is an advocate of the new Can-Spam Act. She's particularly fond of Section 6, which she helped write. Bypassing issues like zombie computers and elusive spammers for hire, Section 6 targets the company whose product is being sold, not the spammer.

"The vast majority of spam has a U.S. connection: the vendor. So you don't have to go to Romania to find the spammer," Mitchell said. "It's easier to find the vendors. When they are on the hook legally, they are all too happy to point the finger at the spammer."

Graham also said the ball is in the court of the credit card companies.

"All spammers selling something are processing the transactions through credit cards. Put pressure on Visa to cancel the transaction and spammers would be stopped cold," Graham said. "So what if it's a Taiwanese Internet pharmacy? Reach them though their Visa merchant account."

Michael Goodman, staff attorney for the Federal Trade Commission, says that going after the advertiser is a route the FTC will take with the Can-Spam Act.

The 20% bounty stuff is slated for September i think.

That is when things will really get interesting... especially if the FTC actually starts proscecuting people and collecting fine settlements.

Imagine how many people will become internet dectives for the FTC. 20% of possible millions in fines, per spammer, is a nice chunk for a days investigation.


I predict that within 2 years, spam promoting US based products or services will be over.

This is going to be a rough battle but Spammers will still find a way.

It certainly appears that this will be the toughest year for bulk mailers.

From what I hear, it has been already so far.

I wouldnt get too excited about it yet. The CAN-SPAM Act may not be around for too much longer - it wont be long before the appeals courts get to start axing it and I hope they do. I would like to see it struck down. I like my state law alot better. I dont like CAN-SPAM because it pretty much legalizes SPAM. All they have to do is provide an opt-out link and thats it. Then its legal. It shouldnt be opt-out, it should be opt-in.

CAN-SPAM also takes away the right for private indviduals to sue spammers - something I am a very big fan of.
