"The napster of porn" ?

Wasn't there an article somewhere where Napster was suing people that use this phrase?

montel 01-29-2004 07:11 AM

umm. yeah that would be me. had a few small problems with trademark infringement a while back.

arg 01-29-2004 07:14 AM

It's still all over the place. I see it in Google Adwords a lot, like 2nd adword on a search for "porn", going to the site napster-of-porn.com, which even uses Napsters logo unaltered.

goBigtime 01-29-2004 07:20 AM

I wonder how quickly google would be hypocrites and stop "The google of porn" :)

... they review every adword eventually so it's unlikely the napster stuff just slipped past them.

BRISK 01-29-2004 07:20 AM

I've always wondered about that. They even use the Napster logo

Whats up?

invertiga 01-29-2004 07:21 AM

napster still exists?

montel 01-29-2004 07:22 AM

napster of porn was cool and converted free trials well.

also, napster was hardly a company that can complain about copyright or trademark infringement.

On that note... are peoples names trademarked or protected?

ie if someone were to use...

"The Bill Gates of plumbing!"

"The Donald Trump of Swimming pools"

That reminds me of a couple commonly used examples...

The cadillac of ___________
The mercedes of __________

Names aren't trademarked, unless a person specifically trademarks their name, but names are protected under "Rights of Publicity."

I've heard "the cadillac of ____" in informal speech and articles, but it would be vulnerable if used as the basis of an ad campaign, and definitely as a company name.

Napster is still kicking. They went bankrupt, and were bought by some recording company, who resurrected the brand and site a few months ago. It's exactly like the old Napster. Except that all the songs come from that recording company. And there's only about 1/500th of the songs available. And the software is completely different. And you have to pay for every song. But otherwise it's identical! :Graucho
