With the flurry of domain sales lately and everyone and their brother wanting to get into dating does anyone think this domain is worth more than the offical GFY :2 cents: ?

Any serious interest let me know. It gets a couple hundred type ins per day.

well it would be more likely to go to arbitration at WIPO through the UDRP.

Matchmaker I believe would have a very hard time proving this domain was registered in bad faith. Adultmatchmaker.com.au would probably have a better case becaues the name is an exact match, still I think this domain would be fine.

match maker is a pretty generic term.

I think Gogo could get away with it... I imagine it would go to arbitration, but I think he'd win.

Remeber Cohen trying to shake down anyone with sex in their domain name?

freesex.com hotsex.com wetsex.com according to Cohen, those all infringed on the rights of a domain he stole!!!

Doesnt matter if it was registered in bad faith or not. Using a name that is likely to cause confusion of a registered trademark is a violation of that trademark.

Go open a hamburger joint called GreatMcdonalds and see how long that lasts.

There are 50+ "matchmaker" trademarks registered with the USPTO....

Maybe you would have a problem with it. Matchmaker isn't in the dictionary, so I doubt it's really generic enough.

well match.com trademarked "match" which is a generic word. Money can buy anything.

Use the domain in a country they don't have it trademarked and you should be 100% fine.

dudes, this is fine... TM is only one element of the UDRP, they would also have to prove GoGo's use is not legitimate and that he registered it in bad faith (i.e intentionally targetting the complainant), which is ridiculous and he can no doubt provide testimony to that effect

Read up about the UDRP, you'll find bad faith registration has to be proved to win the domain.

I don't need to read up on anything, this has nothing to do with UDRP and whether or not someone can keep a domain name.

This has to do with US Trademark laws and the Lanham Act. Matchmaker.com has their name trademarked and any variated use of that name most likely would result in a Federal lawsuit with the defendant giving up the name, all profits derived from the name, attorney fees and damages. Understand now?

True, and the loser of a WIPO decision can always challenge the winner in court.

No, I'm considering selling it.

It's been registered for a long time, it would be hard for anyone to put up a good fight against it. It existed as a site years ago (1997ish).

Anyway, if I want legal advice I'd call my lawyer. Just wondering if anyone is looking to buy :)
