Content theft warning - Hustler and VCA are on the rob!
 

If any of you had distribution deals with VCA that did not included electronic rights you maybe in for a bit of a shock. Hustler have brought out VCA and have started selling the DVD electronically.

Their view is that they want full blown rights both electronic and traditional.

We have just found tons of our DVDs being sold as leased feeds. When we issued cease and desists against the companies theycould produce model releases etc. and promtly informed us that they had acquired the content from VCA/Hustler.

There is pretty much nothing you can do apart from cancel the deal and approach another US distributor.

I would just like to thank Rocki at CEN for helping us and would like to say a big fuck you to Top Bucks who only managed to repond to a months worth of emails last night when I posted in one of their threads about possible legal action.

Hustler are now denying selling the DVDs electronically even though all the feeds showing the streams are the American version tailor made for Hustler and the ID's etc that the content providers are using are ones which were forwarded to Hustler.

Anyone can rip a DVD not everyone can get model releases.

Yeah, loads of the big video companies in the UK who gave master copies over to VCA so that there DVD's and videos could be distributed across America are now finding their content online.

VCA were purchased by Hustler who have now stated that they will also be selling the electronic rights, usually in the form of leased feeds.

The great thing is that they are not paying for this.

Well, evidently VCA/Hustler hasn't been bought out, so there's been no transfer of licenses - which means this is unlicensed content, yes?

what leased feeds are you talking about and what lines does VCA distribute that you own/produce?

Well I have heard that all porn DVD distributors want Internet rights, at least partial Internet rights, they won't take on product that has all Internet rights already sold off.

Do the rights that were originally given make it explicitly clear it is only for video and not internet distribution? Is there any grounds for legal action?

There is grounds for legal action. No electronic rights were granted when the initial deals were done.

VCA are giving the content over to Hustler who are passing it onto various leased feed guys. They are not selling it through the Hustler plug in but via other channels. The guys at Moster Cock have wiped our stuff and told us that they were granted the rights to use it from Hustler/VCA. The documentation they had was from VCA/Hustler.

Something is going to get very MESSY!

It all boils down to the rights of the dvd and what exactly the rights to "distribution" consists of. If not worded right distribution could mean just about any form of transferring the content.

explain this a bit better.. you sold rights to the content... or you used them as a distributor? if you sold the rights it's all in the wording of the contracts... if it just says rights and not specific media types then it can very easily be argued internet rights are included... all our contracts specifically state media genre and future media genre... i can give more details if you want
