Since sending spam is legal now as long as you follow the rules can i sue a isp if they decide to block me?

do you think you have a RIGHT to use that ISP or is it a PRIVILEGE?

The ISP can terminate for any violation of their TOS just like they always could............. That part of the law is rather specific.

You probably would need to go through the proper hoops to prove to them that the list is opt-in in order to get on their whitelist.

Since ISP is a commercial organisation, they can block whatever they want.

even if you did have a case, you'll need a whole wack of cash... :winkwink:

You will still need a Bullet Proof Hosting, regular isps don't want to have their names envolved with spam...
