They will lose... Microsoft has unlimited funds to fight that sort of thing. The publicity they will gain from "fighting spam" will be so huge it will more than pay for the costs of the whole thing.

It is in their best interests to go after them to make a point and look good in the public eye.

I imagine the same would hold true to the NYS Attorney General come elections.
