Legal question: Buying porn from overseas -- Legal or not?
 
If the content is illegal to produce in Thailand/Philippines/Indonesia/some parts of Europe does it make it "legal" that it is being used for paysites based in the US? I guess my question is, where is the content legal... in the country it was produced or in the country where it is distributed?

Can the local source of the hardcore content sic the Interpol on the global distributor?

Remember, this question is not about obscenity but the fact that hardcore porn is EXPLICITLY illegal based on the countries' laws.

That would be evidence of a crime in that country. It doesn't seem like a webmaster who buys it in another country would have problems, but I'm not a lawyer, so I don't really know.

go ahead and buy it, then maybe do a small stint in the hooskow, but you will liberate a small nation from their fear of their own bodies :thumbsup

Quick update: spoke with a buddy of mine and here's his (non definitive) answer --

The content might be legal in the place where it is bought HOWEVER, if the content provider is based in a place where it is ILLEGAL to produce hardcore, he/she can "legally" stiff you because the contract is "void ab initio" (ie., fails to form) because the subject matter is illegal. Kind of like going into a contract to do something illegal or buy something illegal. US courts won't enforce it, good luck trying to get it enforced in the foreign jurisdiction (they might throw YOU in jail for trying to contract the production of illegal material)

Definitely consult with an attorney BEFORE you go into a deal with somebody who produces illegal hardcore porn overseas. This is NOT legal advice... if you're uncertain, consult with an attorney first.

I saw on COPS once how a crack addict paid someone for her drugs, and they didn't give it to her so she called the police. Same basic deal here.

Somebody sells you CP, and what are you going to do? The contracts were never valid to begin with, so do you hold all the blame?
