Federal officials may not prosecute marijuana smokers whose doctors say pot is their only medical relief ? at least so long as the users grow their own or obtain it from other growers without charge, a federal appeals court ruled Tuesday.

The 2-1 decision from the U.S. 9th Circuit Court of Appeals in San Francisco would protect many medical marijuana users from prosecution in California and six other Western states ? Alaska, Arizona, Hawaii, Nevada, Oregon and Washington ? that have laws approving the use of marijuana for medical purposes.

Under the U.S. Constitution, routine law enforcement matters are normally handled by the states; the federal government can be involved only if the alleged criminal conduct involves federal jurisdiction.

Atty. Gen. John Ashhahahahaha and other federal officials, including Drug Enforcement Administration chief Asa Hutchinson, have pursued marijuana cases, saying they have jurisdiction because drugs are sold in interstate commerce.

Last year, based on that rationale, federal drug agents seized marijuana used by a number of individuals throughout California, including Diane Monson of Oroville, who smokes the drug to treat chronic, debilitating back pain.

How else would the US make its money from drug sales if it started allowing the grow state of america to start allowing folks to legally grow as they want?

having lived here for some years now, its a very releaxed attitude towards pot. Even having friends get busted with some pot on them and the cops simply taking it and not even writing them reports.

But no doubt the redneck president still probably considers:

and cops don't write reports for marijuana possession because it simply isn't worth their time. it's a shitload of useless paperwork.

Ive been in another state and had a friend get a few days in jail and after 2 years probabtion, the judge piss tested him in court and after he turned up positive fined him and added 2 more years of probabtion for smoking a joint with 4 people.

Lousiana does MORE than just write reports for pot man.

IN addition, get pulled over between Houston and New Orleans with pot and see what they do.

I have been around herbs, and drug dealers forever and have SEEN the difference in multiple states.

I feel lucky and somewhat FREE in california, but not in other states.

I'd have to agree...over 10 years ago I was popped for speeding outside of barstow and we had over an ounce on us in a baggie with the heaven written on it

all the state troopers did was dump it on the ground and laugh at us as he tapped dance on it...didn't even write me a speeding ticket.

If it had been in Texas back then I woulda spent a few days if not a few months in jail...and if it had been like an hour or so further into our trip and I got busted in Nevada no telling...back then they used to have signs that said something like..."don't even get caught with a seed...."

I can't wait until they just legalize it...it'll happen maybe not in our lifetime but it will...can't keep it down forever.
