Do I need a model release for this?
 
We got a small digital camera to take amatuer type pics , the thought was its small enough to take everywhere and my wifes members like to see her in everyday type of stuff. Here is the question if she took a picture with someone dressed and unsexual like a snap shot. Do we need a model release from that person?

If so no then you dont need a release.

No...He means like if I was hanging out with you and he took a shot of us sitting together and smiling. Or a pic of me kissing you on the cheek.

as far as i know, if you're in public, then a release is not needed.

My understanding: If it's in public, then you don't need a release. If it's in private, you do. However, the "don't need a release" thing doesn't protect you from lost friends if they get pissed that you added them to a porn site.

It realy depends where you come from. All countries have different laws about this and I guess in the states you even have different laws by state to state

The right answer, except he did not go far enough. Ask a lawyer is the full answer.

If you live in the States and capture the image of a person that is able to piss with you in court you will find a model release a useful thing.

If you are shooting in public, make sure the people in the back ground stay in the background and out of focus.

Wrong if you are gonna display a persons image on something you better have permission unless that person entered a place via buying a ticket where as the tix say they have permission to use their image.

Your best bet is to ask a bunch of armchair lawyers on a board notorious for its smart ass webmasters.

It's better to save your money that you would spend on a lawyer and put it in an interest bearing account so when you go to court you'll have some money for court fees and what not, and also if you have to pay a settlement.

Before you post anything that can get you into trouble, sneak a quick peak at your girl and think twice. Do do anything stupid. FOR THE LOVE OF GOD!!!

Actually, (and in all honesty) I'd seriously put money aside for a lawyer that you can retain for a year so that you can ask him\her these questions. It's better to be safe than sorry, and I would NOT trust the advice from GFY'ers unless they were a laywer or had "RED" in their names.

Also with a lawyer you can have him\her go thru your sites and make them as safe as possible (protection is your friend)
