Question: Freehost companies & Stolen Content
If a free host is informed of stolen content how long should they be allowed to keep this on their servers before I can take legal action against them?
This certain free host is claiming I did not give them ENOUGH proof that the content is mine. Although, the pics in question have my company name on them, I emailed them from our company email address, I left them a phone number to reach me with any questions. I got through this at least 3 times a year with these clowns and they continue to say things like: our customers could sue us if we take down their page. I know he knows my name and I fight with him everytime about this. Any suggestions? |
Have your attorney serve him a C&D order and a letter of warning about the next time it happens, he will be filed on as well.

How could someone offering free hosting service be sued by discontinuing their free service, unless they set themselves up for that in their terms of service?

anybody running a free host should have it in the TOS from the get-go: questionable content --you got one day ( or less ) to deal with it or we do ( buh-bye ) ...

It shouldnt take more than one or two days and one or at max two complaints before that material is removed, otherwise you are just wasting your time, escalate it, or forget the matter.

That's some bullshit about sueing. Just write their upstream hosing provider. All US hosting providers have policy regarding copyrighted content. And it's pretty straight - breaking copyright laws is a violation leading to service termination.

Dawg...Get a lawyer on this shit ASAP. They're not listening to your complaints, and it's time for a C&D and some legal action on your part. Also contact his host see if they can help take this guy down. But I would definitely go the lawyer route because they'll just be up on another host in a few hours. :mad: @ :BangBang: them.

By the way, who is it? Out them on the boards. Granted, the smaller guys who use free hosts probably won't care. But, their advertisers will. Hit 'em in the pocket.
