XBIZ: Do you have any views on Acacia?

LENS: I find it interesting that Acacia is not suing the major media companies like ESPN, NBC, CNN, and those sorts of companies. The fact that they claim to own the technology of streaming media over the Internet is something that other people claim as well. It's a long road in the patent fight ahead. Some people have chosen to settle with them. I don't think webmasters should hold it against those companies that do, but it remains to be seen what comes of this thing. I prefer to run my business and move forward. Typically, I'm more of a fighter then a settler though.


Is Lensman one that is fighting Acacia...or has he signed? He was not asked directly...so do any of you know the answers?

I personally agree with what Lensman said..."I don't think webmasters should hold it against those companies that do." It is their business and they have to base their decisions on what they perceive is in the best interests of their individual businesses...not "your" individual business.

On the other hand, some webmasters might find it better for "their" individual business to not do busines with those who have settled. That's not a character attack, just a business decision.

i dont want to come near whoever put out my info. if i cant trust them with my info then why the fuck should i make them cash and trust them with my traffic.

I agree it is their business to pay the money if they want but
anyone who hides the fact that they settled is a big fat CHICKEN

Why should the little guy take up the slack and get sued for thousands cause the BIG player millionares settle for pennies ?

The whole system of how one is suppose to pay is bullshit anyway since the majority of the smaller time players have a very small amount of videos. The license should be based per the amount of videos you run if the patent is even legit.


I wish someone would revamp this country before it goes down the drain any further.

I do find it funny that they are not after the guys like espn , cnn and so many other big big boys there doing this . I am sure in the end this will BIT them in there ASS as well ! Can't blame anyone being uncomfortable when people are turning over private information with no court orders or without the Police being involved.

It is in the interests of all webmasters who are sending affiliate traffic to move their traffic to companies that are putting it all on the line and fighting the patent.

I think it has been stated that they are going after the "low hanging fruit" first...probably in hopes of setting precedent.

I think the facts prove otherwise.

The universities they have locked horns with are anything but 'low hanging fruit'.

Maybe everyone is 'low hanging fruit' in comparison to Microsoft, or Apple... but who wants to go directly after Microsoft or Apple.. you might want to make a little money before you take your beating.

It was a good summary of how webmasters are looking at things, especially ones that settle (ie. Hustler).

I don't fault any company that licensed the patent...i understand that reasons, i have talked to so many webmasters on the phone, and after looking at their choices, we sometimes come to the conclusion that licensing is best for them....

Where i do find fault is those that settled have every reason to be supporting those that are in the fight against patent abuse, but think that just because they settled, they can ignore the issues.

For those that have settled, pay attention to USA Video (http://www.fightthepatent.com/v2/USVO.html) ..they could be the next ones to easily target anyone that licensed with Acacia since their patent covers "downloading of video faster than real time".

While IMPA is looking after all kinds of issues, including patents, Fight the Patent Foundation is ONLY focusing on patents.

Companies on their own cannot handle a patent infringement case. It's too expensive. The patent holders (http://ynotnews.ynotmasters.com/issu...303/page6.html) know this.

But if companies join together like with IMPA (http://www.impai.org) or like at http://www.YouMayBeNext.com of FTPF, then as a group, a common defense can be established with lower financial burden.

"United we stand, divided we fall" rings so true when businesses are faced with patent infringement and licensing issues.

Lots of prior art found by me and by several webmasters who have taken up the search to find evidence of downloading audio/video from a server prior to 1990... the truth is out there.

It is simply now down to money, everyone who signed up to Acacia is funding them to fuck the rest of us. Acacia would not have survived this long if every company that could have afforded to fight had stood with the likes of Spike and the other defendants. Acacia would have gone bankrupt.

But no Acacia chose their target industry and calculated that some would settle because it was cheaper to pay out 2% or get a sweetheart deal than to shell out for the defense. All the time funding Acacia, while mouthing that they hope IMPA are successful in their efforts. So they do not have to payout after someone else has done their job for them.

And all the time while the rest of us are worried about getting summons these guys do not even have the balls to stand up and say "YES I SIGNED UP AND GAVE THEM YOUR NAMES" They reckon that most of their client are so much sheep who will continue to buy or send them traffic what ever they do to them. How many of you still buy from Matrix, send traffic to LFP?

Acacia also calculated some would be to fucking cowardly to stand up to fight and some would simply not be able to afford it.

How do you find out if your content provider or Sponsor signed up is simple. Ask them directly if they signed up and if they are licensed. They lie they are in deep shit if you get served.

The whole thing about Acacia makes me sick, so many times I've been told the Internet is the future for porn supply, if not already the biggest porn supplier. Well that is BS and the proof is the way we have collectively responded.
