The only thing they will have to do is stop selling trademark terms in those countries if they are notified by the person who owns the trademark.

I've read that Google will usually remove listings if you own a trademark and you ask them not to sell it as a bidded term.

I think Yahoo won some similar cases in the U.S., but France is not known for their free speech laws, so it's possible they could lose.

These kind of suits are really tough to call, a win for Vuitton would mean a wave of suits to follow against Google and would involve Google having to make a large infrastructure change to Adwords to prevent trademarked keywords from being listed. On the other hand, a win for Google would mean that trademark owners are being deprived of their value on their respective trademarks. It seems to me that for each TM violation, a simple email would get the keyword removed.

I have bid on TM'd keywords before and those TM owners simply contacted google to remove them and that was the end of it.

Google should give a special spot (like on top of adwords) for the trademark owner, but rival competitors should still be allowed to bid

I hope google loses. I love google and all but in all reality they are in fact conspiring to intentionally dilute trademarks. That's the way trademarks work.

Vuitton is big co. but I'm sure Google has already examined the legal field for such cases.

In the past they contacted me for some trademarked keywords (after complaint of the owner) politely asking me if i want to remove them. They didn't force me to do so.

3 years ago I said that the search engines should get there asses kicked in for doing exactly what Google and many other search engines are doing. Selling off trademark terms for PPC.

It is all a bit late in my opinion, strange that it didnt happen earlier on before it got way out of hand.

I think so, but a saving grace to the issue maybe is the fact the search engine was trying to offer the consumer alternatives to a brand they are seeking on the net. However concerning a trademark search it is pretty different matter entirely.
Try Playboy for example on a search engine.
What do ya see? Ya will see many other things but not necessarily Playboy and thats a pretty clear violation on a trademark term.
