Spent Some Time With My Lawyer
I spent some time this morning on the phone with my lawyer discussing my Acacia letter. He said that Acacia's "business plan" is old school legal shenanigans.
He recommended that under no circumstances am I to licence their "technology" without proof that their patent is valid stemming from a fully contested legal decision. He mentioned that I am free of prosecution because I only host banners and do not actually push the video content across the internet. The attorney recommended I should do nothing unless I was sued which would require Acacia to prove they own the technology and that I caused damage. Acacia's favorable injunctions mean nothing. He mentioned that if Acacia decides to sue enmasse that we complain to the California Bar for fraudelent practise (especially if some of the decisions go against Acacia: Holio.net?). My attorney mentioned off-hand that Acacia most likely purchased a stolen list(s) of webmaster information from an employee(s) of a larger player(s) and that this was common practise. |
Wow, good information there, thanks. I'll be speaking to my own attorney about the matter if necessary, obviously, since every case is different, but that is some good information you've got there. :)
