Crazy Thought about Acacia
Ok......so some of you will think I'm nuts, but from what I understand, whoever settled is paying a percentage of 'All' their sales, right? Whether it be 100% movies or 25%movies & 75% pictures.......
How much would it cost a paysite owner or paysite owners to make one entrance for their pics/stories/chat & whatever else they may offer, and one entrance for all that + movies? The advantages are that: 1) you don't have to pay for the customers that are there for pics only (don't have fast enough connections to download movies) 2) you remove any liability from the affiliates that don't want to be implicated in this bullshit extortion 3) perhaps charge an extra amount for the movies portion of the site and a little less on the pictures & whatever else portion of the site. Does this sound retarded? |

Maybe they should be on different boxes or considered (lite) but if I'm not buying the movie package & you're not charging me the movie package (obviously because there is no access to movies) then what are you supposed to give them? In my experience with royalties - we used to have many different ones and they weren't getting a percentage on all sales, just on what pertains to their 'product' ......... Like I said it may be retarded, but I think it's a way to go around it - legally while a judgement is made in court. Also, if the judges decide this is insane (probably when it reaches the big mainstream guys) do Hustler, Vivid & the rest get any money back? ;-) |

too confusing, but one thing you have to remember, everyone that settled so far didnt do some 2% deal, it was a sweetheart deal probably for a fixed amount, etc. Nobody has signed a non-sweet deal yet.

They shouldn't be able to charge you for something that people aren't paying you to do, right.
Maybe the costs involved would probably be greater, but it's something to look into if all of this becomes the norm. It'll probably be a way to work around it. If there's an upsell - your affiliate can get credit for it - but they aren't promoting it. Got to get this checked by a lawyer but let's say, I'm promoting a site: anydomainlite.com (pictures only) and the surfer then decides they want the option of anydomain.com (pictures&movies) what the implications are for a webmaster/affiliate. We're promoting the picture site - so the commissions coming from the movies portion can be charged - but not all our sales. If in fact, they win in court and this will be the norm in paying them any rights, there has to be a way to work so they don't get a chunk of everyones business when it only represents a portion of it........ Maybe I should get another coffee..... |
