I got my Acacia Letter, but there is 3 problems with it

ok now guys, This is just way too phuckin funny.

I got a letter from Acacia, Yeah it was addressed to Marsha Youngs. But the domains Associated with this letter I don't own nor do I have the right to..

Two of the domains listed on mine were Xbiz and Xbiz Awards. Now isn't that some shit? LOL

I was only an employee of XBiz. These people have NO idea what they're doing, who they're sending these letters too or what you have on your site. They are just sending and that is such bull shit and it is such a shame that our judicial system is allowing such to happen.

This is the big company so many "players" settled with. I'm keeping a nice list of people who won't be "playing" with my money ever again.

Two of the companies that have settled.. I did sign up for accounts with so that the judges of the xbiz awards last year could access their sites and judge them.

And I used my real name to signup for those. Funny huh?

find names of all senators, politicians
put their names on that paper, buy envelopes and start mailing.

letterhead on papers must be from acacia.

for website enter: whitehouse.gov or govt website of their home state.

Awesome idea. Better yet, let's send it to the owners of the various senate, house of represnetatives, and GOP personal sites.

I wounder how long Acacia will be running around after that!

lamrobertson 10-24-2003 05:42 AM

lol they sent me a letter too. For a site that isn't active and I am Canadian and they don't have a Canadian patent. I called them but no one bothered to even return my call.

Or, maybe better yet, send them to "Microsoft, Intel, AOL Time Warner, Disney, Universal, Apple, Sony, Tivo, Replay, Direct TV, Akami, On Command, AT&T, Comcast and let's not forget Verizon Wireless." (these were the promised "Potential corporate partners / licensees, to name just a few" being hyped exactly a year ago- http://www.jagnotes.com/archive_jagn...02&startrow=11).

I can just imagine the ensuing conversation...

"Uhhh, we weren't quite ready to get around to you yet, Mr Gates, sir. Figured we'd hook up with the porn industry first, you know..."

There ARE some though, like Lightspeed and a few others that settled because it was a smarter thing to do, but they are still leading the fight against Acacia legally and are contributing huge amounts of money to the legal defense.. It's the companies that don't do anything about and just sit back and write their checks, and sell all their affiliates up the creek that should be the ones on your blacklist.

Acacia is tryng to set court precidents so they CAN go after the bigger fish.. They are simply taking out the "easy targets" first.. Who's gonna stand up for th e porn industry, right?

Better yet, get a patent for some wierd made up invention, and then send your information packets to business all over the US, to tell them what you INTERPRET your patent to mean (rather than what it ACTUALLY means) , and then accompany it with a licensing schedule.

Example.

A patent of having a web page that used color to highlight key words within a page in order to draw attention or help give direction to said item.

Translation:

Notice how links on your web page are a different color than the rest of the text, you infringe on my patent.... if the link color was the same as the text, then you wouldn't be able to tell where the link was at. IN addition, having text highlighted in a different color draws attention to the points.

Licensing schedule (yearly fee):

Based on PageViews:

1 - 100,000 = $1,500
100,001 - 500,000 = $3,000
etc.

You have until Nov. 30th to take advantage of these introductory rates.

I am not advocating that people patent everything they think of... patents are not bad, only bad patents are bad.

Bad Patents are ones that prior art, or the use of the idea or the idea, existed before the patent.

Patents that are novel and unique deserve some IP protection.

Lightspeed settled and are contributing to the Defense Fund??

I thought they were a defendant against Acacia and contributed to the Defense Fund (the pooling of financial resources by the 11 defendants).

Actually, one of the IMPA guys posted last week or week before that none of the settlers had donated or helped. Tho they did say a number of them were saying they did, when in fact they had not.

nuclei 10-24-2003 06:27 AM

Marsha, dont feel bad. We got the letter too yesterday. Funny thing is it was sent to a name/addy we only used at ONE place.

Was it one of the settlers? heh..

BigFish 10-24-2003 06:27 AM

How can there be PRECEDENT when there was never a court decision on whether the patent was valid or not? Only precedent that will be established is the decision on the homegrown case challenging the patent.

Ahh ok that might contribute to my confusion. I think those that haven't settled will be vindicated soon enough.. This latest round of bullshit from Acacia is QUICKLY destroying all semblance of legitimacy as far as I'm concerned, and I'm sure a court would see it that way too. I mean for cripes sakes, if you're going to try to sue someone for money, at least do the fucking research to back it up! They are SO desperate to boost their quarterly earnings to impress all their new stockholders and try to keep their stock going up, they are grasping at straws now...

Yeh they are doing that. However so is our own industry. As long as webmasters keep buying their stock to try to make some fast cash, they will just have more cash to fight us with. I mean come on guys.....

Yeah, but concievably some of those webmasters could be hit with insider trading, as Brad suggested. They know about the licenses before they are announced, so they know when to buy. I don't think that's going to go over so well.

I think webmasters who are busy buying up Acacia stocks are traitors to their own industry. I guess they are going to really be the ones to feel the punishment though when Acacia goes down in flames, and if I was one of those webmasters, Acacia's latest tactics would make me VERY fucking nervous.

SpaceAce 10-24-2003 07:18 AM

Just to get something straight, Lightspeed did not settle, did they? When LadyMischief posted that I was thinking, "How the hell did I miss that?" I would think the settlement agreement would prohibit any anti-Acacia activities, anyway.

This points out one of the major problems with getting your information from a board. Half the shit people post is bullshit and the other half they made up.

So, I'll just tell everyone that LSC settled and if no one calls me on it they'll lose a bunch of affiliates that get pissed off at them for settling and if somone does call me on it I'll just say "I believe it was my mistake" and I'll be off the hook.

People, if you don't know what you're talking about, just don't talk.
