Got that dreaded letter today.

I do not have a single movie on any of my servers. I simply link to sponsor hosted movie galleries. Just like millions of sites do. So now ACACIA is going after anyone that even links to a site that has movies on it? This is getting stupid real fast. Hasn't this already been upheld in court that a website is not responsible for the sites it links too?


On a different note, I have avoided the Acacia threads like the plague until now. It is not that I do not care, it is because it does not directly affect me. The sites that have the movies on them are the ones that are responsible, or at least this was my understanding. If a sponsor I use has to reduce payouts in order to fight and/or settle with Acacia, then I would have no problem whatsoever in taking a reduced payout. But to say I am infringing when I only link to movie galleries? This is beyond absurd.

I don't use video, and I won't until ACACIA gets its head ripped out of its ass by the courts, but if they send me a letter I'm not the least bit afraid of letting it go to court. I don't like the idea of showing up in court because I'd rather people not know what I do for a living, but there is no way I'll pay them a dime when I don't even use the technology they "CLAIM" to have a patent on. So if it goes that far, I'll be heading to court, I guess.

The wording in the letter can be usefull to anyone fighting thier claims. They are saying that if I provide access to content VIA my website. This can be seen by many a judge as a bullying tactic. Am I infringing upon their patent if I link to another site that does? I don't think so. This has already been held up in court rulings if I recall correctly. Courts generally do not like bullies.

what about some type of counter suit.... u can sue people for harassment in this country... seems like thats what theyre doing... just harassing webmasters into paying... they know that a lot of people cannot afford to fight them...

I'm looking at it this way.... the crap they sent me in the mail is nothing more than snail mail spam. Might as well be a Publishers Clearinghouse package. They wanna send me a subpoena, let them. They can piss their money away. I'm not sending Acacia a fucking dime.

The way I see it, and I'm no attorney so i could be wrong... Bot suppose company "A" supplies videofeeds for websites, and company "A" pays acacia thier fees... ok now since the fee on that video has been paid, why would company "B" who leases the fee also have to pay? Its already been paid by company "A"!

And why would the webmaster thats sending traffic to company "B" thru links also have to pay?

Sounds like bullshit to me. They wont see a dime out of me, i do not provide video, and I damn sure wont pay them cause the sites that I link to provide video.

This letter that they seem to be peppering webmasters with from some sort of database. Is it legal? Meaning do you have to legaly follow up with them? Or is this just there way of scaring people to do that.

To the best of my knowledge you need to be served or at least sent a certified letter for it to have any sort of legal backing. Am I correct here?

then why are they not going after Google, Yahoo, and all the other search engines? after all these search engines have more links to video than any adult site could ever dream of having...

Acrapica is plain and simply targeting a narrow group of websites on the net and trying to extort money... I mean really if they are truely worried about protecting their patent then google and the rest should clearly be a target...

I have no video on my servers and I will go to court if I'm ever served...no way in hell I would ever settle.... but I really don't think Acrapica would waste there money on me so I'm honetsly not worried..
