Spam re Acacia

Last week I sent out an ICQ message, to everyone on my list, about Acacia, IMPA and Fight The Patent.

Unbelievably I got three webmasters reply asking what it was all about, they had no knowledge of Acacia or the fight this industry is in regarding the patents on streaming. Not everyone frequents the boards. L

So today we are sending this out to all those on our email list and I want to run it by you and see what you think.

Quote:

Our industry is currently under attack from companies that hold legal Patents. These companies are forcing webmasters to pay them a license fee to stream video on their sites.

However some companies believe these patents are far too broad and will be invalidated in court. They are fighting this instead of just giving in. These companies are now faced with massive legal fees to invalidate these patents.

Should they lose this case, then you will have to apply to Acacia for the right to stream videos on your site. Should they grant you this right they will then fix the fees they think applicable. They can refuse you.

There are also two more companies with patents similar to the one Acacia holds waiting on the outcome of this action. Should this one be lost they can come and ask for you to apply and for pay a similar license.

The two organizations fighting this on behalf of the industry need you support , as little or as much as you can. If you are not aware of this issue can I suggest you look at these sites and learn about them, you may not do videos today but you may need to in the future, protect your future today.

What do you think? Feel free to make comments, I want this understood by everyone.

Any one else with an email list of people in the industry can use this and send it out with my best wishes.

No it's not sad, it's up to us too get it out there.

Some people do not read the boards because they think they are full of stupid idiots posting garbage and no help to them.

It's our job to get this out, that is why I told everyone they can use my text or do it themselves.

Sponsors, Content producers, billing companies, hosting providers. Get your lists out and use them.

They were also saying simply downloading a zip of audio or video ALSO infringed on the patents too, not just streaming. ANY transmission of compressed files in those two formats were under their umbrella. :glugglug

sounds good to me charly. get's the point across. hopefully impai can stop them.

Thanks Gemini will include that.

20% are very concerned about the Acacia issue another 60% will never know who Acacia are and the final 20% are rubbing their hands at the perceived opportunity that Acacia has given them.

sexeducation 10-13-2003 02:45 AM

I think it's good ...
It's given me the idea to change the "join email" and "login emails" on my site to include a FightThisPatent.com and IMPAI.org blurb. And mentioning any compressed files downloading is very good ... as it brings the message home.

Someone test www.impai.org for me it looks like it's down.

Let's not make a big deal about this.

Just switch to FightThisPatent.com ?

This thread needs to die.

Phoenix66 10-13-2003 06:01 AM

Why noone just blow the damn Acacia's main office into air? They are bastards and parasites by default. Why allowing them to propagate?

:BangBang: :ak47:

That is a first thought that came into my Russian criminal mind. LOL

Small addition if you like:

---------------------

If you are a content producer or sponsor with an affiliate program and want to get a summary of the patent license issue as it relates to your decision whether to signup with Acacia or not, email brandon -at- FightThePatent.com

------------------

I think I have tapped out on getting pledges from postings on message boards, so going the route of contacting each sponsor and content provider to give them my opinions on the issues, since November 30th, acacia's cut-off date for their "amnesty program" is looming.

Thanks so much for all the attention you are trying to drive to this issue.. it is very concerning that most just don't know or don't care.

I don't want "amenesty" - what do you mean "amenesty"?

looks like this router:
206.169.234.54 (206-169-234-54.gen.twtelecom.net ok)

is not forwarding to 206.169.228.107 IP for impai.org or the IMPAI.org server is offline

Packets to homegrownvideo are making it through this router.

Hi Brandon
I just emailed out everyone on my list the email. Got some nice positive feedbacks from many. You really should ask sponsors, content providers and any one else with a webmaster email list to let you use it.

One woman said this.

Quote:

All Acacia wants is money. They really have _no_ legal ground. They came after me and I had my attorney respond.

We wrote them, they wrote back, my attorney responded, and since then they have dropped it. I suggest to anyone who is being pursued by them that you merely respond and are clear about your desire to actually go to court and fight it, it is likely that they will move on and not pursue you.
This was maybe what a few more should have done rather than ignore it and not even turn up in court.

Can you ask a lawyer if there is some way we can counter sue Acacia for sending the "Packet" and harassing us?

yes, this is my current strategy... almost done with the email...already have had some email me with requests to receive the info..... I will be contacting all sponsors and content producers with my email message about my summary of the patent license issue....for those that want the email faster, contact me via http://www.FightThePatent.com/v2/Contact.html

I keep all information confidential, and i don't "blab" anything on the boards... i have had some emails that wrote they have to settle, but they don't like it.. i don't look down on these businesses that have no choice to settle.

If webmasters have email lists that can send a message from me on about all of these patent abuse cases and about my efforts with Fight The Patent Foundation, it would be greatly appreciated.
Contact me if you can provide this service.

So many people wanted AOL to stop harassing them from all the CDROM's they sent out for AOL... One group of people collected like a million discs and dumped them at AOL (or maybe that was an urban legend)

Its a good idea and yes a LOT of our members also do not visit the boards.

Far-L 10-13-2003 08:37 AM
