Hey, have any of you paid Acacia for apparently violating their patents?

I'm still trying to figure out what it is that they claim to have patent on.

If I offer audio/vidoes on linux server to customer without any type of streaming, then Acacia has nothing on me from what I understand.

very interesting. It seems that lots of crazy ideas for patents are getting approved. I heard one company patented peanut butter & jelly sandwhiches without crust. And someone patented name your price online also.

Any kind of HTTP server or FTP server would assist in the delivery of an audio or video file, therefore infringing on Acacia's claims.

Sponsors and Content Producers, I am creating an email for you to present my observations about your issues with Acacia's patent (ie. licensing). While I can't give you a definitive answer to do or don't license it, I can give you some things to consider when making your personal and professional decision.

I have had several already contact me, and I feel it is good informaiton to share in email, rather than posting.

This is because they managed to get most big companies (we mean BIG here) to settle with sweetheart licenses. Much like they are doing now with hustler/vivid.

I saw a stat somewhere that said that companies sueing to inforce their patent win 48% of the time....

probably what happens is prior art turns up and the claims get invalidated......

so it comes down to the same probability of winning in court as it is with a toss of coin...... given that as the beginning odds and the fact that prior art does exist...i say the odds are looking really good for the defendants to win.

yup, patent got slammed.. but that was before they collected like $27M+ in licensing fees.. so these guys know the drill, already perfected it with the V-Chip, so they are executing the same plan... looks like it is working on the big boys.. but not working on the smaller guys who are taking a stand.

One webmaster thought he wasn't violating acacia's patent claims either because he didn't have any video on his website, but had links to a video gallery that he licensed or linked to for free.

I had to inform him that according to Acacia, he is a contributory infringer, and that they could go after him....

So if you don't link to any websites that have audio or video AND you don't have any audio or video on your website (this includes flash and director files), then you may be in the clear.

I link only to sponsors and most of those sponsors have settled. I am more than confident I am in compliance but I do agree on fighting this patent.

I do not have or link to any online videos (or pics for that matter). I run an SEO company and simply redirect traffic from SE's to sponsors. Additionally, most of those sponsors have settled with Acacia. For these reasons, I have belief I am in compliance. But like I said, I do want this patent overturned.

What will be interesting is to see how much Hustler, Vivid and Wicked are paying. Just see what the next quarters revenus is.
