ARS terminate account because of a phrase
 
One of my friends has had their account with Adult revenue service terminated because their site has a phrase that

"contains \"girls gone wild\". This phrase is trademarked and is in our Terms of Service."
Is this absurd or in the U.S. can anybody trademark a simple phrase like this and have it protected in such a riduculous manner.

How was the phrase used? "Girls Gone Wild" is almost becoming a common term, I've used it in conversations before when not referring to the product. You would think they would offer a little leniency.

I would imagine a warning should be in place since terms get added to their TOS without webmasters really knowing about it. Just a casual reminder to change the phrase would be enough if you ask me...

On another note, I didn't realize ARS had started becoming so concerned with copyrights, it's about time after all my complaints.

He (the girls gone wild guiy) is still in jail for on charges of shooting and and having sex with minors. I think he has more to worry about then someone using "his phrase".

he was probably terminated because of the way he used it. if he was using it on a site for an insane asylum he would have been in the clear. but still they should have given him a warning first, most people dont read over the TOS with a fine tooth comb.

We don't terminate accounts. We put accounts on hold. If your account was put on hold for the use of Girls Gone Wild that is so you will contact us immediately about changing it.

GGW is VERY strict in protecting their brand.

Simply remove, reply, and you'll be all set!

Bottom line is if you do something against the rules and get cancelled, its your fault. Read your sponsors terms and rules and OBEY them! If they say you cant write "and" anywhere on your pages and you do, well they can cancel you whenever the hell they feel like it. They make the rules.

Not that I agree with that.

im wondering if GGW tapes are still advertised heavily in States like in the past. They hit europe as well lately with some annoying tv commercials.

You can use 18 consecutive words ( to desribe something from previously used text - More than that is considered plagerism.
Words or part of - If a company/site says they own certain words - All you need to do is run a check on those words and find out when they were first used -
Playboy - For example - Try and screw anybody that uses that term -
In an English court - Playboy would lose hands down as the term Was used in a 1926 novel - Long before the magazine ever existed.

If a common term such as GGW is banned, next time it will be sex (because of sex.com), amateur pages, deepthroat (because of the classic movie with the same name), etc.
ggw is not a name but some commonly used words.
