C&D me, you only fuck yourself.
 
On January 29, 2002 I received a cease and desist letter via federal express from Internet PM ordering me to discontinue the use of the term " ADULT TURNKEY" on my company's design site. Shortly after receiving the letter, I called the president of Internet PM to discuss the matter. The pissant explained to me that he had the best lawyers in California and that I had 24 hours to remove the term from my websites or he would sue me.

Hogwash little pissant.

That afternoon, I contacted my attorney who handles intellectual property and we begun the processing of having the trademark office revoke the pissant's registered trademark.

Last week, the USPTO cancelled registration of the trademark " ADULT TURNKEY".

I guess the pissant hadn't yet heard of my attorney.

I would like to thank Brad Shaw for paying for 1/3 of the process to have the trademark revoked and cancelled. Many here are big talkers, Brad is one of the few who consistently puts his money where his mouth is. Thanks again Brad.

Steve was the attorney of record on the registration. I do not believe he was involved in the cancellation proceedings.

I'm curious as to two things:

1) Why did Brad Shaw offer to help pay to dissolute the TM? Not complaining, it's quite a nice thing for him to do, just wondering what he had to gain by it.

2) Isn't Steve Workman an in-house attorney for NetManagement? Name rings a bell, I remember talking to him a couple weeks ago about another legal matter.

Steve was on retainer for a lot of webmasters before going to Net Management. In fact, he did my trademark paperwork for "amateur beaver", funny thing is that his current employer owns amateurbeaver.com

We sold 100's of turnkeys years ago (still do sell them, but they do not fly off the shelves like the old days). Made sense to support Jeff's fight.

Brad agreed to help pay the costs because he sells adult turnkeys (at least he used to). This was an issue that touched all designers that sell turnkeys. I contacted several others and none were interested in helping. Nice huh? People don't realize that these issues that come up touch us all. Some are willing to help, most become unavailable on ICQ. Pretty sad really.

The registration occurred when Steve was in private practice, before he went to work for Net Management.

Yeah, something like that. If I get around to it (which I won't so don't wait for it) I will scan our pleadings and post them somewhere. Section 18 is the part of the trademark act which addresses cancellations and appeals.

Yes. They filed a response to our challenge. Other than that, I don't know what transpired back and forth. I have not yet received the final file from my attorney.
