C&D me, you only fuck yourself.
On January 29, 2002 I received a cease and desist letter via federal express from Internet PM ordering me to discontinue the use of the term " ADULT TURNKEY" on my company's design site. Shortly after receiving the letter, I called the president of Internet PM to discuss the matter. The pissant explained to me that he had the best lawyers in California and that I had 24 hours to remove the term from my websites or he would sue me.
Hogwash little pissant. That afternoon, I contacted my attorney who handles intellectual property and we begun the processing of having the trademark office revoke the pissant's registered trademark. Last week, the USPTO cancelled registration of the trademark " ADULT TURNKEY". http://tarr.uspto.gov/servlet/tarr?r...entry=76000603 I guess the pissant hadn't yet heard of my attorney. I would like to thank Brad Shaw for paying for 1/3 of the process to have the trademark revoked and cancelled. Many here are big talkers, Brad is one of the few who consistently puts his money where his mouth is. Thanks again Brad. |
Awaiting the owned pics...

if it didn't work out I would have changed it to ADULT TURKEY

am I the only one who noticed that Steve workman is the attorney of record for that?

Everyone who is selling turnkeys, please make sure you properly kiss my ass! Seriously though, Jeff did a great job going through all the procedures to fight this. I just wrote a check.
|
Congratulations. Somehow Brad keeps earning my respect. Shh... don't tell anyone!

Good Job!!!
:thumbsup |
I'm curious as to two things:
1) Why did Brad Shaw offer to help pay to dissolute the TM? Not complaining, it's quite a nice thing for him to do, just wondering what he had to gain by it. 2) Isn't Steve Workman an in-house attorney for NetManagement? Name rings a bell, I remember talking to him a couple weeks ago about another legal matter. WG |
Steve was on retainer for a lot of webmasters before going to Net Management. In fact, he did my trademark paperwork for "amateur beaver", funny thing is that his current employer owns amateurbeaver.com
We sold 100's of turnkeys years ago (still do sell them, but they do not fly off the shelves like the old days). Made sense to support Jeff's fight. |

The registration occurred when Steve was in private practice, before he went to work for Net Management. |
Thanks for clarifying these two points Brad and Jeff. And Congrats on the win.

I believe workman has resigned from net mangt also.
if I'm wrong dont sue me :) |
Current Status: Registration canceled under Section 18.
? What is section 18? Ie: was this you cannot TYrademark a common use phrase? |

I tried to explain to the pissant on the phone that I didn't think his registration would hold water. That is when he started in with the "best lawyers in california" and "I will sue you" bullshit. He shouldn't ought to have done that. |

I thought he resigned just before I went to Italy... no connection, of course ;-))) |
I have enough trouble keeping up with my own employees, I can not keep up with JB and Joe's.
My experience with Steve Workman has always been very positive. |
Almost makes you regain a little faith in the system. A huge :thumbsup
|
Excellent outcome JMM, and thanks Brad for stepping up and financing a part of the case. Everyone benefits in the long run for whatever reasons you donated the cash....:-)))
|
Wow this brings a tear to my eye..
Im so proud of both of you... Ive raised you right boys.. Chris |
Did the other guy fight it?
Or was it like a default win for you? Chris |
Nice move Brad ! :thumbsup

Steve took very good care of me in the past. |
Congrats guys! Fuck these cock holsters
|
My thanks to JMM and Brad. I never heard about this or I would have contributed. Fortunately for me my turnkeys are still flying off the shelf and I want to keep it that way.
Thanks guys. |
As the traditional porn industry starts feeling heat of overexpansion, crack down by VISA, its hard for the cockholsters to continue their practices of ripping off surfers.
So now they are turning inside and going to go after their counterparts.... The whole patent things that have been going on, is part of this. I promise you there are people inside this industry who are working to undermine YOU, and to take the money that you have worked hard to earn.... Patents, trademarks on obvious silly things will be their weapons, and the attorneys will be their soldiers.... This is just one drop in the bucket! Hats off to JMM who is the front line of this battle and fighting like a champ!! |
impressive :thumbsup
|
Nice! Very Nice JMM!
Did you grab that domain this week? AdultTurnkeyWebSites.com dropped. :Graucho |
