You know I also saw where they signed with the company that owns Interactive Galleries and reading through their content provider list it looks like they are going to have a few more targets now. I found it especially strange that David Lace was one of their providers.

Imagine if Larry Flynt and the other legends had given up instead of fighting back over the years.

The people who are giving in to Acacia now are benefiting from other people's years of fighting, but they aren't willing to fight themselves.

If weak people aren't even willing to stand up to a bad patent, what will they do when the Justice Department comes knocking?

Just curious.. do you have a rough guesstimate when this will be?

I mean a when a major showdown or something will go down.

Far-L 09-19-2003 07:33 AM

The Larry played by Woody Harrelson who saved porn in the movies is not the Larry of reality.

Don't expect Larry to come in like a white knight here. In fact, don't be surprised if Hustler settles. Why wouldn't they? Acacia has offered them a sweetheart deal because, imo, they know that if Hustler caves in then a ton of others will follow suit.

The worst part is that every settlement offer I think Acacia has made so far has involved getting off by selling out on those around you. I think I heard Hustler was even offered a cut of adult licensor revenue to do a deal.

What would you do if you were the real Larry Flynt and not the fictionalized version? Would you want to spend tons of cash to fight for everyone elses right not to have spend cash or would you take a deal that would potentially give you a cut of almost every adult site's gross income?

There are no heros here. Only businessmen and women who have to make difficult decisions.

All I have heard is that this could drag on for years before a final decision is made. However, big news will come out constantly.

This is an intellectual battle of epic proportions. We are talking Iliad and the Odyssey here. There will be many battles. There will be retreats, advances, surprise attacks, massacres, enlistments and defections. There will be heros falling on the field of battle and others who live forever by virtue of heroic deeds. There will be traitors. There will be innocent victims. There will be glorious victories and horrendous defeats.

No one knows or can predict what fate has in store for us or Acacia.

All in all, by Zeus, we will do our very best and hope that the Gods smile upon us as we make the long trip back from dealing with this sad affair.

ytcracker 09-19-2003 08:39 AM

i dont really disagree with the larger companies settling. if you have more to lose i can see where this is not something you want to gamble with.

keep the fight going though throw the tea in the boston river

LadyMischief 09-19-2003 08:42 AM

They aren't making nearly as much with the agreements than they are spending on lawsuits. THAT does not bode well for their future. Nobody's pockets are endless.

Keep the fight going? By settling, don't you think the fight is lost.

I really don't know all the details, but by making ANY type of settlement is agreeing that THEY have a right to be paid and if that is the case, why go to court over something you have already admited to?

Did that make sense?

I think in any situation when you go to court that no matter what, when you settle, you admit guilt. So here is a company making claims, here is another company(s) stating they have no claim and that they cannot do this, yet on the other hand they are paying them for the use of this as if they have a right to be paid then fight them as if they don't....

That does not seem right... If you strongly feel that they have no right to collect money from you for your streaming... then DON'T settle.... Stick to your guns. Now this company can come back in court and say.... "Well, if we didn't have a right to be paid for the use of our technology, then why are these companies settling?

Sorry, it's early for me and I have not had coffee yet... so I might be babbling.

Far-L 09-19-2003 08:49 AM

Interesting reference to the American Revolution...

Where would our country be today if Thomas Jefferson and other landed gentry of his day decided to be Royalists because it would be easier and cheaper that way...

Would Elizabeth II instead of Washington be on our dollars today?

Give me liberty, or give me death!

rooster 09-19-2003 08:50 AM

They are losing money quick, and the companies they are signing are just sweetheart deals that wont make them a ton of cash.

Thats what makes it even more stupid for companies like cecash and tcg to cave. They are just covering their ass instead of taking a stand, and prolonging this nonsense instead of helping to squash it as quick as possible behind a united front.

not neccesarily.

frankly, in these wild legal times, i don't fault any of these larger companies for settling because in effect it squashes their beef and they can move on to bigger and better things. as LM said, the money that they are garnering off these settlements can't begin to justify their legal expenses. my guess is these companies are settling for beans just so acacia can claim that they have these people under their belt.

in this case, it's up to the littler companies to group together because acacia doesn't stand to make as much money off of them anyway as they would these larger companies. once their patent is invalidated (i am more than confident it will be - their allegations are a tad bit farfetched), i'm sure most will question the resolves of the companies that decided to settle and their faith in the industry, but you have to understand that larger companies cannot afford to put all their eggs in one pie-in-the-sky basket. it's a strategic move on the part of the company that i'm sure we can all understand on some level.

You know, if I were doing streaming video and these fuckers came to me with this shit I would just tell them...

No, you did not give me this technology to stream... Microsoft, Real Media and QuickTime gave me the ability and the technology to stream video... I paid for these programs so I have paid for my right to stream... Now go fuck yourself.

But that is just me.

How can it be invalidated when they are getting settlements? Getting a settlement is the same as admiting that they do have a valid right. Don't you think?

The same thing happend with their vchip stuff. They got some to settle, but then lost in court against some big boys.

just because something is being actively enforced or attempting to be enforced doesn't make it right.

there was a time when women and blacks couldn't vote and it was right.

there was a time when noblemen had prime noctem on their fiefdom and it was law.

extreme examples, but this is technically a no brainer.
you can't hold the patent to something if you didn't invent it.
i can't go patent the sun or breathing or any of that shit.
there is solid concrete proof that this technology existed before acacia claims to have invented it/held the patent for it.

as i said though, these are crazy times, logic is not always on the side of truth.

No, I agree.. like I stated a few above... This technology was provided to me by the software I purchased... Why should I pay another company for something I have already paid for?

Are they going after CNN, MSNBC, or any of these other big sites that stream a ton of video? Or is it just adult they are after? Again, not right... if you are making this claim.. go after everyone like RIAA... hell, they're sueing children for christs sake... Now that shows me a company is serious.

*technically* though the same could be argued by paying for kazaa's premium service. if i pirated software and you bought it at a discount, just because you bought it doesn't make it right.

the actual foundation for the technology they are describing existed prior to their patent. regardless of what claims they say have, the history is unwavering and unless they have a delorean at 88 miles an hour i think it speaks for itself.

marzzo 09-19-2003 09:26 AM

I wonder where Adult.com stands on Acacia. Obviously whatever it is will be hush-hush but I'm curious...

But unlike Kazza... I am not stealing copywritten work... The company that created the software to stream would be the one at fault... All we did was buy their product. If they are selling stolen technology they are the ones that should be in the courts.. not us. After all, they are still selling the software to stream right?

slapass 09-19-2003 09:33 AM

I did not read TCG's deal but CE's deal said they get out of it if the patent is proved false. Pretty tough to go into court and say "CE caved so should everyone else" when both parties agree that the patent is questionable.
Also you can settle without admitting guilt or wrong doing.

::the good news is that I don't stream so I have less of an interest::

Rob Berman explained clearly why Acacia is not going after Microsoft and others.

They do not see it as a profitable or necessary. Acacia considers the streaming technology supplied by those companies as just a single elelment in their patent and not the full method.

tony286 09-19-2003 09:38 AM

What I dont understand and please someone explain to me. I can see the v chip thing they went to the companies that built the TV'S . We dont build the software that streams, its the software companies using their technology not us. How come this hasnt been brought up in anyof the interviews or radio shows? I drive a taxi ,I dont have to pay a licensing fee to the guy who invented the transmission, thats Fords responsibilty. Maybe thats how it should been approached in court instead of a patent battle.

That is just don't make sense... how can you target only one group in a court of law and have any validity in your claims? If they were serious about this then they should be going after EVERYONE like RIAA is...

Just a thought.

Has anyone filed a countersuit claiming discrimination?

Far-L 09-19-2003 10:53 AM

I can answer some of these questions and some answers will be available shortly.

They can sue whomever they choose. They can enforce their patent against whomever they feel it applies to. They are not only going after the adult industry. Berman has made it clear that they could go after mainstream media sites like the sports sites that D$ asked him about.

I am not an attorney and I am not about to discuss any legal strategies on the board.

As a company owner that disagrees with what Acacia is claiming, I can say that I will fight fire with fire and do my best to product my company from this type of liability.

All the best to you, I hope it works out.

I understand not letting out any legal stragities... I am just having a hard time understanding their logic.

You have stated that there is no money in going after mainstream... but I would think there would be more, especialy going after the companies who have created the software using the stolen technology.

Personally, I am still new... just opened my program last week... if they were to come after me.. they would get nothing, I have nothing for them to get... I am not making a ton of cash yet... hope to, but as of today... I am just some slob working out of a spare bedroom trying to make a buck. Let them come.... :)

Do you think that these sotware creators are even aware that this is going on? I mean they are the ones providing the tools, the hosting companies are providing the streaming servers, all we are doing is making videos... How are we responsible for these royalties is what I am having a hard time understanding...

... because lawyers have an endless appetite for money, and "settling" puts a stop to it. a lot of settlements admit no guilt on the part of the accused or anybody else. it just gives the people who sued what they were originally after --> money. it's the american way ... :1orglaugh

I imagine in the end it will be interesting to see what is really going on behind the scenes in some of these agreements.
