solution for canadians
 

so after all this visa bullshit what's the solution for canadian webmasters ? or the only way is to incorporate in usa/europe (if yes do I need to be citizen there or what will I need) ?

I probalby haven't read enough posts on this subject: could you fill me in on what "this visa bullshit" means? I would be interested to learn more about the problem, and investigate a solution...........

canadians cant use visa to process unless they have a US or EU presence, hence alot of people are with smaller paysites are fucked

And NV is good to inc yourself too I heard

NV is good if u dont want ppl to know what company u own.. just look at the casinos there.. very hard to see who owns them.. lol

delaware has good bankrupcy protection. thats why everyone does it there.

a quick note: all our canadian companies who are pretty big internationally have inc in delaware. hehe

and if I incorporate in delaware do I need to be citizen there, or I just pay X amount of money and I'm all set, also what about double taxation ?

From what I remember hearing from the billing companies origionally was that if you were doing the US corp approach, a US citizen had to own the corp or be the majority shareholder in Visa's eyes. So, doing the whole corp thing (from what I heard origionally) will eventually get ya nuked.

Incorperating in Europe... Most countries you have to pay a 15% VAT tax on all transactions. There is 1 country I believe that Visa considers part of Visa europe that doesn't pay the tax. Don't recall it offhand. Then your processing options are IbillEU or CCbillEU basically. I don't trust the EU parts of those companies to still exist in 2 years (100% personal opinion). Don't even consider other processors, they will be gone faster then you can say dutchbilling, globill, acpay, or the upcoming *cough*probilling*cough*

Simple stuff... you need to incorporate in Europe and you do not have to be a citizen or any of that shit. Suggest you look at either a UK company or you can use an offshore corp in Gibraltar.

Either way, it means you avoid all the VISA US problems and have a choice of more processors than exist in the US.

Note... Incorporating in the US or Delaware/Vegas etc does not exclude you from the processing problems within the US.

It just makes sense to actually avoid VISA US and the fees... you might as well incorporate in Europe and put the "Visa fees" to buying a corp and actually have something at the end of the day. (There are no fees for Visa transaction processing other than in the US).

Yup.. watch out for VAT. If you have a UK company that does not trade in the UK (ie net stuff) - there is no VAT - or taxes payable in the UK. (A document from the UK Revenue exempts the tax). In the instance of Gibraltar there is no VAT or taxes due on non resident companies.

Answer to citizen stuff = no. There are dual tax treaties between Canada and the US. This is another reason to consider Gibraltar :)

I like what "The Click" said: that he uses a third party i.e. Probilling to take care of the VISA issues............

I can help with incorporating in the EU. As for having third party "take care of the VISA issues" you may want to look at your own merchant account instead, VISA isn't overly happy with third party billers these days. We can assist people getting there own merchant accounts in the US or the EU.

Incorporated in DE last year. Using Ibill ( wanted to keep my rebills) with no problem. I do use a US bank account ( TD waterhouse) so they can ACH to it.

Added also a local US phone number and a 800 number going to my canadian offices.

So far, so good .

Like Webby said, the EU looks good also. In fact, I think I will do a EU one, process a smaller site, just to have either as a back-up.

Accounting: talk to your CA. I have one in Montreal and a US one in Plattsburgh.

The only problem with this is IF they go ... under VISA pressure.

Then you loose :

- your money
- your rebills
- at least 2-3 weeks to setup with another ISIP.

No problem to go with them, but at the same time set yourself up.

Corps incorporate in Delaware because they have the best corporate state laws for the most part.

Nevada is used be a lot of people as well

also I don't get it, how will it work in terms of receiving checks or wires ? If I incorporate in EU can I make checks come to Canada or they come to Europe somehow and then how do I cash them and transfer money here ? clue me in =)

I know IbillEU checks don't easily clear in canada. Assume the same is true about CCbillEU. Problem is US funds drawn on european bank to be cashed in Canada. Aparently they can be cashed, but not easily like US checks.
