Shall we take PSW Billing to court ?
 
If PSW owe you money then read this.

I propose we launch legal proceedings against PSW seeking immediate injunctions preventing PSW from wasting funds on legal action against VISA until such time as they pay their webmasters in full.

I'd probably go so far as to say PSW should be put into administration as they obviously have no interest in doing the right thing by their clients.

Discussion ?

I think that fighting the credit card companies in court is a step in the right direction for the industry. I don't know what your situation is with PSW but I've always known them to be stand-up people.

Well Im not willing to bet the money PSW hold in reserve for me on the slim chance they might win against VISA. If PSW are so badly off they cannot pay their webmasters then their pockets are nowhere near deep enough to sue Visa.

Did you read what you wrote?

If you take them to court for not being paid, then won't the same money spent on legal fees to sue Visa, just go to legal fees for your case.

hmmm... ok, I just don't get it.

I do not know the story with them, but maybe you are not getting paid because of the Visa issue and that is why they are suing them... to get YOU your money.

I believe PSW suing Visa is a blind. When they go broke, as looks inevitible, they can blame Visa rather than themselves.

If PSW were financially prudent then they would be able to pay most of their webmasters. VISA didnt suddenly steal 50% of the money PSW held.

I don't know how much of a legal background you have, but a class action suit just ain't gonna fly here for several different reasons. Hard and a bit lengthy to go into detail.

You're best bet (if there is still one left, because they can declare bankruptcy at almost any time), is to go after them solo in court.
But you need to get an attorney that has a fair amount of smarts about themselves as to how the net works, and especially ebillers.

Maybe ask for attorney referrals from others on gfy that have gone to court over internet related issues?

I am a client of PSW. They have always paid me the money they owe and moreover have been wonderful people to work with.

In response to their "potential" case against Visa....who knows the outcome but the reasoning is several fold....

1) Visa is coming down very hard on the industry. If no one stands up to them and the industry keeps quiet, they have a license to kill with us. The squeaky wheel gets the grease.

2) The credit card processing companies and banks are our primary spokes people because they interact with them on a consistent basis. No matter what the banks and processing companies will make money, no matter what happens......Isn't it nice that someone is standing up in regard to our future and our future right to make money on the web with out a cap being put on it?!!!!

3) If they owe you money, get on the phone and speak with them. Don't bash them on a board!!!! No one else here has had a problem, perhaps if you made a phone call and illustrated what your issues are, I am sure they will appropriatley address them.

4) They may actually change policy and/or more realistically it may never go to trial and will be settled out of court.

Never underestimate the power of one person, or one company, to make a change.

Look at the guy who sued the government over the pledge of allegiance and the use of the word "God". Class action lawsuits against Blockbuster for their late fee policies. Smokers suing the tabaco industry.... etc. etc. Thousands of examples exist. This country was created on one person being able to take someone to task in a court of law. I don't have a PSW account but do FUCKING appreciate SOMEONE having the balls to do SOMETHING about it and represent us.

Last I heard PSW had paid everyone. Anyone personally have money that hasn't been paid to you?

Ya know, I was around with MaxCash during the whole FTC drama that took place a few years back. Back then, when 100% of my traffic were going to them, I was totally *panicking* with them. I was waiting on a $6800 check for the month (those were the days!) That was Oct 2000.

I didn't think I'd see that money, but the lesson learned there was "diversify".

6 weeks later, all months owed by MaxCash to their affiliates were paid. And confidence in the industry was somewhat restored. :thumbsup :thumbsup for them.

Now, I don't do a lot of business with PSW. I'm just an affiliate promoting one website on PSW, so, sure, it's a small check I received in the mail yesterday ($76 USD), but once again, my confidence is restored... I'm a lot more cautious sure, but, it's nice to see companies really sticking their necks out.

Way to go PSW for promising to deliver, however small, and doing so within weeks of reporting your on going battle with some of the real crooks in this business: the banks and the CC companies.
