hey guys have a ?? about mailing out dvds
 

we are looking at setting up a mailing out for some dvds from a site we are doing as they join we will send them a dvd , is any one doing this and can tell me what areas to look out for or to be in . not looking for a lawer , just seeing what some may know on this matter thanks jim :helpme

There is a list of zipcodes you cannot send to - Digging for it now

Also if you sell a Membership wait 30 days before they get their DVD. WE used to do that - Buy a membership get a free Video - People got their video and charged back. My charge back ratio went thru the roof. So we stopped it

That list is a psuedo myth, there is no official list, just zip codes distributors guessed at around the Meese Commitition. Which can only potentially hang your ass. In theory what you would be doing is saying I will not ship to this area because I think it is obscene there. Now what happens when someone orders it somewhere close to a "prohibitted zip code" at say a P.O. Box or whatever and then picks it up and drives to his home in the bad zip area. You still can be tried in that zip code area, where you already publically stated "my material is too obscene for that community". Also do not forget about the lovely "choice of venue" laws/terms.
