Lawyer??
 

I was directed to this board after posting on PJ's regarding images and video that someone has posted of me on his site. I mailed this person asking that they b taken down and after getting no where with him and him claiming he has a right to have them cause he watermarked them *LOL LIKE WHAT?* He has no signed model release...no copy's of my ID and never had the rights or permission to have any of this content posted.
His last mail to me.....
"I guess you will have to read and download the images and the full "The *my real name* Story" in the next scheduled update, I promise it will be a good one"

I really need some advise on what to do about this guy. Ive been told to contact the RCMP. theres alot more..I have EVERY e-mail saved and printed...I have video taped the members area of his site with all of the content that is there. Im hoping someone here may know or has delt with a situation like this. I work VERY hard at what I do and one shady person in the industry seems to think he can do as he pleases and steal from everyone else.

Technically, neither of you have the rights to use the photos.

If he took the pictures, technically the copyright belongs to him. However, since he doesnt have a model release, he cant use the images in a commercial manner.

Talk to a lawyer. DMCA doesnt matter because he holds the copyright. You are basicalyl stating he doesnt have the rights to use the images because there is no model release. If you are young enough looking, you can try the 2257 avenue (contact the local authorities) which may or may not work.

as for the content he doesnt have a model relese or a copy of My id, I never agreed to let him use any of the images nor was never told these were being posted anywhere.
His last mail he admits he plans on slandering me across the internet because I asked him to take the images down. I will definatly talk to a lawyer regarding this.... thanx 4 ur help

Talk to a lawyer. This is an odd situation. I think your best bet would be that he DOES defame you across the web (which is libel, not slander). Then you stand a chance of getting something out of him. I doubt he has anything, though.

There are easier, cheaper ways to deal with it, though.
