Fuck Shaw in Canada
We thought we had a settlement with them on the ongoing litigation over their claim they own the trademark on the name Shaw.
To make a long story short, we could not agree on details of the settlement. I wanted to be reimbursed my $30k in legal fees. So next week, my lawyer flies to Calgary to depose the CEO of Shaw Communications. Going to hammer him about Shaw Cable and the porn they carry. Anyone have any dirt on this guy? JR Shaw, Exec. Chair, Shaw Communications Bottom line, fuck Canada, they are going to cost me the $100k I made last year defend my last name! |

The Canadian Shaw Communications is quite a large company, ranging from cable television to high speed internet (which I'm sure you knew). And with a $3 billion dollar market cap and $1.5 billion in sales, they ain't small potatoes (http://biz.yahoo.com/p/s/sjr.html).

We have been fighting them for 2 years, this is nothing new. We will prevail. Sure they are huge, but their claim is ridiculous.

Saying that you can not fight the 10000lb gorilla is inaccurate. Shaw had our domain Shawinternet.com turned off, we got in injunction and had it back on within 24 hours. They have offered settlements so we would not contest the trademark ( I think they want weaker people to cave to them, they do not want a fight), and we could continue business as usual.

Don't listen to these jackasses who think just because it is a big company litigating with you that you don't have a chance. I successfully litigated with Mastercard and got them to drop a frivolous suit against one of my sites that so called infringed on their advertising. Keep your faith and good luck! DH |
Honestly, I could care a less about the domain shawinternet.com which is what they initially wanted. But at this point, it is a matter of principle.

I'd say you don't stand a chance Brad. It would be like saying that Ford or Hershey or similarly named company doesn't hold exclusive rights to their name and trademark, which of course we all know isn't true. Try starting up a company using the Ford name and find out how fast corporate litigation can some your way. The fact is they've been in business a hell of a lot longer than you and have a whole lot of corporate trademark to back themselves up.
