Scammed.........

I am super pissed at a guy on this forum.

He came to me for hosting saying that he could not pay for it straight away because someone else scammed him; so being nice and wanting to build a long term relationship with him; I offered him hosting to tide him over.

Now the guy tells me that he used our servers for only 10 days etc and the rest of the time it was on backup and decided to pay me only for 10 days.

The amount owed is not very much about 2K. But it is the principle of it all. He made a k a day using our servers and when he was down and out; I helped him out and now he gives me this type of shit. What would you say?

Should I name him? He is quite prominent here.

Work it out in private, or buy some tylenol and expect a long day in a thread, and really nobody is gonna care.

BRISK 08-13-2003 08:24 AM

Name him. People need to know about how others do business.

Brisk what are you saying? Your gonna not do business based on one persons point of view? Unless all the facts are out, its not fair to slander somebody, and if all the facts come out who wants to read all that crap?

If he feels he was scammed, then I'd like to know about it, and I'm sure many others would as well.

If you're not interested, then don't read the thread.

I am interested.

I have received part payment but I am still pissed as hell and guess I needed to let some frustration go.

But in your opinion, do you think it is fair to have another hosting and then claim you only use 10 days when it was up for some time? I like to hear your opinions, it isn't the money but I guess how i feel about being scammed. To me I feel I was taken for a ride.

I will not name names at this moment, because I still treat the person as a friend, but would you do this to your friend? Just wondering.

who's next?

LeeNoga 08-13-2003 08:44 AM

Not saying its cool to engage in bad faith deals and business practices but I think you can leverage using a Public forum THREAT to resolve this in private and if they do not resolve this well...

Spill the beans.

I cut him a deal because he said he needed to feed his family etc; so i gave him a deal; I mean how many people do you know would give a person hosting without payment first? I did that. Instead he turns around and tells me that it was not good etc.

Here is the deal, he needed hosting to make his daily cash; so he used my servers for it. It made according to him a k a day; enuff to get back on his two feet would you not assume? After payment is due, he tells me he didn't use it much. I taught him a lot and instead he gives me this type of crap; Oh well, I will not really say much on who he is really but if you really do need to know if you need any development work email me first so as not to be scammed by him.

Nato I appreciate your discretion not to blast this persons name across a Public forum.

Let me interpret his last post, somebody contact Nato in private and get the name of this gent, and then YOU blast it across the forum and everyone wins :-)

Name is outted and Nato did NOT do it but would be Ok with it if it leaked.

Somebody complete this plan, so I can get some points :-)

Here is a bit of logs for you all to see:

You have sent a message!
so you will be post paying instead of prepaying

You have received a message!
2000 at the end of the month.

You have sent a message!
work it out if you can
you need more time
come to me

You have received a message!
5 sign ups a day with his program is 5250 a month, so yes, I can promise to do that.

You have sent a message!
i am not going to take your last 500 bucks

You have received a message!
thanks

Just before payment was due....

You have received a message!
can I wire it? there will be a shit hell WU charge on 2000 bucks, even if I broke it into two payments

Here is his arguement afterwards:
You have received a message!
if you wanted 31 days worth of money, you should have given me 31 days worth of uptime.

Here is his answer later on....
You have received a message!
your resolution is to pay you for service you did not provide, and to continue to pay you in the name of friendship.

What do you think guys?

Well how much downtime was there?

If it was a few minutes here and there he's being an ass.

Seems he is trying to weasel out of paying. Did he even ever complain about downtime?

Gutterboy 08-13-2003 09:54 AM

Only in this industry are people so reluctant to name names. If someone scammed me like that I wouldn't even ask, their names would be in the thread title.

He never complained until it was time to pay.

There are no friends in business ..... friends are the main reason you will lose money. Name him, so we can all learn by your mistake, and ........... be friends :)

Let me think about naming him for a while

The more I think about it the more I am pissed.

Well if he never complained until it was time to pay, he is bending you over :)

Post his name, he's trying to rip you off and you should protect others from getting burnt by this person.

Seems you bent over backwards to help this guy and now that he owes you the money he's trying to weasel out of it. He owes you the full amount you agreed to period!

Are you saying as a host this guy should pay you for downtime? Im not sure I understand the full picture, but was there that much down time? only 10 days up out of 31? If this is the case Im suprised he paid you at all, if its not then maybe you need to clarify or I need to drink less

Ironhorse 08-13-2003 02:24 PM

Sounds to me like your 'friend' is having a hard time, maybe you can work out some payment plan. Also you said he partially paid you, this doesn't sound like a scam, maybe you're overreacting?

DonCorleone 08-13-2003 02:25 PM

Simple solution.

1. Check your server logs, and add up all of your downtime.
2. Calculate exactly how much $ you should take off of what he owes you.
3. Offer him the discount, and mention that you can prove the downtime.
4. If he doesn't bite, let him know it's a last ditch effort before you go public on the boards with the issue.
5. If he still resists, post his name.
6. Send him the URL to this thread.

Kevlar Hosting 08-13-2003 02:47 PM

How much downtime was there? What does your TOS say about making up for downtime?

nike 08-13-2003 03:44 PM

Was there any such thing as a contract, I know it seems unconventional here in the wild, wild, west, but I've heard talk of such things in the 'real' world.

Nah, I'm just pissing with you - if you had a deal, a mans word is his bond, and all that shit. Still I am always surprised at the amount of shit people will agree to, without thrashing out all the details.

itsgonahappen 08-13-2003 03:52 PM

Nope, I am not saying that he should pay me for downtime; We agreeded that it would be a 1:1 uptime replacement; which is what we offered; but he said he only used 10 days according to him; we had more uptime then that.

He said another host scammed him out off 1k + so he didn't have enuff money to pay me initially. But he is able to make 1k per day if his site is up; so the deal is to help him get back onto his own two feet with my hosting first.

Now that he is back on his own two feet he screws me over.
