Acacia on the D$ Show TOMORROW - Final reminder

OK, my last thread was dying. It said next week on it anyway, and now it's this week.

So as a recap, Robert Berman from Acacia will be our live talk show guest. The week before we had IMPA's Spike and JMM speak this opinions and facts about this patent that effects all streaming media, video and audio.

In the IMPA's opinion, once in court, this patent will be proven to be invalid. As of now, it's valid.

What does Acacia want from it's license holders? Who are the license holders? What exactly is the patents claim? How can we learn more about compliance with Acacia? Can you patent an idea using existing mechanisms to create a new mechanism? Will an end user have to pay to stream family videos on their homepage?

Are non adult companies also being targeted? If so who? Who has complied in the adult and non adult?

This will be a show you won't want to miss. Be a part of it and join the live chat room in both java and MIRC (#xbiz). Send your last second questions to my e-mail and I'll do my best to ask the cream of the crop. darren @ marketingfirm dot com

Show starts at 12:00 pm pacific / 3:00 pm eastern time and will be a special 2 hour in depth edition. Callers are welcome, for sure!

Last week's archive is inside the "live show" section if you'd like to listen to JMM and Spike from IMPA.

I think it's great that just about everyone agrees we should have them on the live show to explain their licensing agreement and answer questions.

I realize I can't control our live chat comments so please behave professionally.

Thanks again everyone.

I have to really think hard if I'm going to attend this thing...I might accidently slip with a barrage of profanity...not very business-like I know, but I take their attack VERY PERSONAL.

Fabuleux 07-28-2003 03:12 PM

Maybe I was the only one struggling with the stream? Maybe prepare some bandwidth this time.

I never received a packet. Appearantly they might have attempted to send one, but one never hit my current mailing address. I was sent a second letter from them explaining that they had contacted me several months prior.

The letter was sent to The Players Ball which isn't hosting the video clips. I had a link on it going to the D$ Show videos. It's still me either way, probably just a matter of time before the D$ Show would have been linked in, since all you have to do is click the link to find that out.

On another note. We are changing the setting of the audio feeds to lower bit rates. I realize our shows have had big audiences lately, last week we had a ton of listeners. I don't want to take any chances with the feeds the way they were. Hopefully this will accommodate everyone listening.

Has Lars brought Robert Bermans sig space yet or is that still up for grabs?

(cough) my pay pal addy is [email protected], if you are reading lars (cough)

Shit I have to get back to work finishing www.boycottacacia.com before tomorrow...

No, just audio in media player.

Just out of curiousity, name other scenerios sort of like this.

Let's use the example JMM gave. They're going after the process, not the mechanism.

So Microsoft invents media player and gives it to their customers. But to use this player is a violation of this patent. Using it's process, meaning you encoded a clip and put it on the net for people to view.

What other situations exist that are similar? I said last week, making and selling water pipes (aka bongs). To sell it is legal depending on the state, but to use it with it's truest intent (weed) is illegal. I know that's a poor example because you 're supposed to use it with tobacco which would make this example, not so good.

What else is like this?

Keep in mind, we haven't had Robert on the show to answer anything yet, so I'm really still in the dark trying to uderstand which parts of "use" are in violation.
