Now acacia says we are conspirators

According to acacias newest request to the courts, because pornslingers did the unexpected and banded together (IMPA) we are now the starters of a conspiracy against him. So now we are not supposed to protect our interests too :P

Someone is getting desperate :P

Ya Nuc,

They're just trying to keep their ass from going down in a ball of flames.

Get some popcorn for this one.

Yes, we have a constitutional right to protect ourselves and our businesses. We're gonna do it :)

Fuck 'em I say.:321GFY

Guess they didn't realize porn guys love doing Gang Bangs together.

Sly_RJ 07-24-2003 12:46 PM

Heh. Of course they don't like companies combining their resources on this one. They're afraid of losing.

Nubianprince 07-24-2003 12:47 PM

Those guys ... are just setting themselves up to fail . :thumbsup

directfiesta 07-24-2003 12:50 PM

Acacia is attacking in courts only the adult side of the business... So why we shouldn't get together.

They would be more credible if they tried to enforce their patents on all the players, including CNN, FOX, US Gov, etc...

'"You can't go to potential licensees and say ?Don't talk to them,?" he said. "There is case law that says (those) kind of activities are prohibited. And now it's going to end up costing them a lot more money."'

'"It is apparent to me," Goldberg said in a July 21 filing opposing the Acacia amendment filing, "from the nature of the allegations? that Acacia is simply seeking to punish? small businesses for daring to band together and fight back? I believe it is Mr. Berman and Acacia's intent to capitalize on the prohibitive costs small businesses incur when defending litigation in order to extract 'licenses' for the (patents)."

spike sure sounds like a smart mofo to me.

iroc409 07-24-2003 12:56 PM

it says they are pushing for a jury trial (acacia is). wouldn't this be somewhat in everyone else's favor, and not acacia? wouldn't you think that a jury would find what acacia's doing rather rediculous?

no, because it wouldnt be a jury of OUR peers... it would turn into an anti-porn trial.

hahahah,
they are out of luck hoping that some "blue color jury" with no clue about technology awards in their favor..

US court system has been amended and now it requires the TECHNICAL expert to provide the judge with the technical opinion on the patent

(see IDC Technology vs Ericson thread on investment boards)

IDC sued Motorola and lost, jury verdict,
IDC sued Erickson and Tech expert wrote the opinion that IDC patents are good,
and ERICY settled, not risking going to court..

If tech experts picked by judge decide that their patent is worth less than my socks before the laundry day,
they be out of luck
;-)))

Consumers are totally pissed at the RIAA. This would piss them off even more.

Maybe a jury isn't such a bad idea?

nuclei 07-24-2003 01:08 PM

i think they came to us looking for an easy kill to set precedence for when they go after the others.

wow...i hope this falls in their face...strong arming people out of money..should be done with a little more tact

Kimmykim 07-24-2003 01:23 PM

Actually a jury trial is the last thing a plaintiff wants or should want. The odds on them winning in front of a jury simply aren't there.
I don't recall the exact figures but something like 95% of suits are settled before they get to a jury, and of the 5% that do, the plaintiff wins in way less than half those situations.

Matrix 07-24-2003 01:42 PM

I would say they are the ones conspiring against the adult industry. Do they think they can do it but we can not? What a bunch of jokers:321GFY

Mr.Fiction 07-24-2003 01:43 PM

This once again proves Serge's point that being defensive with these guys will get you nowhere. It's time for a major offensive.

The people being harassed by Acacia need to go on a full scale offensive, both legally, and in the media.

Every time Acacia makes an attack, the people they are attacking need to legally attack them back twice as hard.

As long as they are allowed to be aggressive without paying for it, they will continue to do this bullshit.

agreed 100%

Phoenix 07-24-2003 02:10 PM

yeah he mentioned going against them in every available country.

they would surely lose in some and that could help swing decisions elsewhere:2 cents:

Acacia has even suggested the Internet Media Protective Association ? the group formed by some of the adult Internet companies to fight back the Acacia patent claims and act as a new interest group for other adult Net issues and concerns ? tried to block Larry Flynt Publications from licensing with Acacia, a claim New Destiny Media/Homegrown Video chief Spike Goldberg says is all but laughable.
.. "tried to block" ... Did Larry Flynt Publications settle too ?

No way! Larry will kick their asses legally, especially once he becomes president in 2004.

Suing the fucking future porn president is not too smart.

Just in case you didn't know, because I've seen you refer to Acacia as "him" a few times now:

Acacia is the name of the company and not a sole indvidual.

Honeyslut 07-25-2003 12:26 AM

I am just a part-time work at home mom with a hubby who probably has a brain tumor.. Why would Acacia want to sue me ?

(sarcasm)
