Acacia - Grow Up!
 

As president of a company that has actually been sued by Acacia and is currently fighting this battle in court, and as CFO of The IMPA, I personally appreciate the outpouring of support.

However...

Grow up folks. This is a real battle. This is a real threat. They are coming after our BUSINESSES, so ACT like business people.

Threats of physical violence are stupid. They don't do anyone any good. On the contrary, they hurt our cause.

Name calling is stupid. It doesn't do anyone any good. On the contrary, it just makes things worse. It makes us look like exactly what Acacia says, and thinks, we are.

You want to defeat Acacia? Hurt them in their pocket books. Help us fight this battle in court. Help us prove that the patents are invalid. Acacia, the company, will live and die on the backs of these patents. Help us invalidate them and you defeat Acacia.

NOBODY is immune. It doesn't matter where you live. If these patents are not invalidated in court, everyone will be touched by this. Canada, Poland, Zimbabwe, Lichtenstein, it doesn't matter where you live.

I have said it before, and I will say it again. It is the position of the defense group, and The IMPA, that the Acacia patents are invalid. We will fight this battle in the courts to prove our case and protect ourselves, our business, and our industry.

You want to defeat Acacia? Then help us. Legally. Ethically. Smartly.

Believe it or not, there are a ton of people (big and small) who don't have a clue what's going on or who Acacia is.

It appears they have now sent the marketing/Licensing package to my US office. Well I was in this fight before this and am still in it.

I realize why ACACIA is going after us...because we as an industry actually make money and we are disorganized....or so it would appear, but they are going to find they fucked with the wrong industry. While some would dismiss this industry as a bunch of cockholsters and fuckups, I've met some of the greatest people Ive met in any industry. People that come from all walks of life, people who've come from rich families and people who were raised in extreme poverty all have made money in this industry.

What happens when ACACIA picks on the wrong company with "family" connections?

While I understand companies wanting to get paid for shit they own, IMHO, ACACIA is going about it the wrong way. They could have made a lot of money by being gentlemen about it but THEY were the ones who started being cocksuckers about this. THEY are the ones that are bringing this rage upon themselves.

So, yeah, I'm a businessman and I handle business in a like fashion, but this is fucking extortion, this isn't business. so, fuck them. I pray they all get cancer of the ass.

It still doesn't mean I'm less serious about this matter and it still doesn't mean my attorney will be any less prepared when I recieve the lucky extortion lottery ticket. You fail to understand business. Until proven otherwise, Acacia is legally in a position to do everything they are doing.

Has anyone from Countries such as Canada recieved a legal opinion on how it will effect us?
In the end, I think they will be defeated as there was streaming media produced before their patents. So lets come out fighting!!!

I'm not saying I have those connections, but to act like they aren't in this business is plain ignorant.

they can have fun charging a son of a parliment member in poland, they cant there u can get of court case easy when u have family in the parliment with a few dollars, have fun!

The FACT remains that they are reading this board (and others) and they ARE taking comments on this board seriously.

What you fail to understand is that the court system is not a bunch of books and ornate buildings. The "court system" is comprised of people. Judges, clerks, bailiff's, etc, etc, etc. If you do have to face Acacia in court, rest assured that comments such as yours will come back to hurt you. If you don't believe that, then you are being naive.

For the record, I do take the ACACIA threat seriously. I, personally, have not yet been served with their nifty package, so I'm not personally threatened yet. However, I understand the trickle down problems we face.

I have a lot of friends in this business living on very thin margins and can't really afford the 2% (especially retro-actively)

I realize this industry is never going to have a political ally in congress, but that doesn't mean someone should be able to come in and strongarm everyone.

My rant was basically what a lot of people are feeling. Everything I stated was opinion and while I'm sure the ACACIA's boys' mothers find them perfect little angels, I not happy with them or what they are doing (and trying to do). I'm doing legally what I can to protect myself and expete others to do likewise. However, a rant on a board called gofuckyourself is hardly anything to do with the way I do business.

ACACIA already looks at us as a bunch of dogs that need to be shot in the head and put down, a couple profanity-laden rants are hardly going to change that opinion anymore than saying "oh, the guys at ACACIA have huge penises and those guys rock"

No but it might make the judge think twice. Get real and realise they will use everything and anything they can to win this and remeber they have just been knocked down on the VCHIP patent. These guys are battle hardened and we are on their turf.

I'm well aware of that. You also have to remember, I have a battle hardened attorney and one who has dealt with chatboard cases. I'm not stating anything other than opinion, I don't know any of the people over at ACACIA nor do I care. I'm not statring anything as fact that might be construed as slanderous.

I can understand people wanted to speak their minds since the name of the site is GFY. In threads regarding serious issues we should focus our energies.

Whether Acacia is right or wrong, they hold a patent which needs to still be contested in a court. They believe they are right, so they're handing things the way they believe they should.

Most webmasters feel they are wrong.

All we can do for now is learn more about Acacia's claims and learn from IMPA what their claims are.

So on that note, we're talking about this issue in a few minutes with a guest from IMPA, JMM.

JMM, while I appreciate what you are doing and I think you will win, the point of being offensive, rather than defensive, is probably a good one.

Acacia is not going to stop making more and more broader and broader claims until people start suing them and making them pay for the problems they are causing.

They can't just randomly claim anything they want and scare people into signing ridiculous contracts. The more people that sue them, the more that judges and other entities would have to start to look at Acacia's business practices.

Just because you say you have a patent on breathing doesn't mean you can threaten everyone on earth to sign a contract that gives you their first born or you are going to ruin their life.
