re ACACIA, people, you are pathetic!
people,
you ARE pathetic! there are hundreds of you affected by ACACIA and all you can do is whine, whine, whine... "The best defense is OFFENSE" your livelyhood been attacked, there is no way to win without getting "blood spilled" like it or not, but you have to spend some money. Get your act together and start filing "Extortion and Civil Racketeering" law suits against them all over the globe, small claim courts with $7.95 filing fees will also do and GET JUDGEMENTS BY DEFAULT like they do! (unless they have and willing to spend millions of dollars to defend those law suit in 214 countries on Earth) the numbers work in YOUR favor. I talk from my expereince, ask Steve Cohen his biggest mistake and he'd tell you: "Fuckin' with Serge" I'll look with interest over this battle, I am curious if youngsters have what it takes to defeat them, like the "senile oldtimers" did in their time, or just be crushed like a bunch of high schoolers you really are... Let the BEST brains win, as always! ...even though I beleive that ACACIA's win is in MY best business interests, as thier win will consolidate the industry and put the small and marginal players out in the cold. I find doing business with big players much more profitable and pleasant ;-)))) |
Serge you're killing me.
|
Good challenge. Now let's see some people answer the challenge with action.
If Acacia will do everything within the law to fuck people over, then people should do the same to them. |
lol, this is the first serious post by serge i've seen to date :thumbsup
btw just did an interview with Spike from HomeGrown on the subject, check it out... http://www.webmastervault.com/tip-sp...ldberg-1.shtml |

That's assuming of course that Acacia's patents are valid, and hold up in court. |
"You face death itself in the form of..... (1) ACACIA "
You May; (A)ttack (B)lock (R)un (H)ide (F)uck them in the ass with a meter ruler. [OR] (f)ile Law Suit. |

The law is a funny animal, jusk ask OJ who is innocent and guilty of the SAME crime! same person, same crime, 2 courts, opposite outcomes. |

there was a child who haven't talked for 5 years... the firts words out of his mouth after five years of silence were.. "The soup is cold" exstatic parents asked him, "Son, why have you been silent all those years"???? - I was silent because all those years the soup was warm ;-))) |

OTHERS come with the patents as valid as the one been presented. ;-)) How many folks were trying to intimidate the entire adult industry after Cohen's drop on his ass? none do you think that would be the case if he prevailed???? |
A company i work for has this motto " They have our money" I guess alot of people are looking at the adult biz now and chanting the same thing.
|
...and when Gary Kremen was threatened with the law suit from Yahoo due to the fact that
http://yahoo.sex.com resolves to http://sex.com what did he do? run away with tail between his legs? nope...he SUED Yahoo! and..won, getting all the press and the media in the process and keeping http://yahoo.sex.com along with http://acacia.sex.com for all eternity |

It is impossible for anyone with half a brain to settle with them under the terms of what they are sending out. Of course those with less than half a brain can do whatever stupidity they feel like, since if Acacia doesn't get them, something else will. |

Omg thats sick! :1orglaugh I wonder if the same guy that wrote the Terms & Conditions for the old XPIC's sites drew up Acacia's contract too :) |
Would it be illegal to nut on a Acacia packet then send it back to them?

JMM,
is my idea ethical and legal enough for you? ;-))) |
Hey Kimmy are you saying that because CE settled they are stupid people that will get walked on??
While I will not take this from them laying down, I understand that some people will, because they think that it will cost them more to pay an attorney for help. But that is a mistake. Serge was right when he pointed out that it will be simpple to get default judgments all over the world just like they did. The interesting thing is that the packet does not have any timelines, they just say pay us. So that gives you the site owner plenty of time to file against them. |

Wouldn't any self respecting courtroom/Judge find that little clause alone to be suspicious? I mean come on. |

First, you would have a tough time getting a lawyer to take these cases. Although I suppose if you paid one enough, he/she would. Second, to file small claims cases, you would have to come to Orange County California. You would have to file them in Acacia's jurisdiction. However, the cases would not get very far. Acacia actually owns the patents they claim they own. The way to fight this is to prove in court that the patents are not valid, and that is exactly what we are attempting to do now. |
Gotta love another egotistical maniac coming in here and proclaiming how he is above everyone else and bragging about his great legal mind.
Yet another indecisive fence-sitter talking out of both sides of his mouth. He admits that he wants Acacia to win, yet tries to seem like a good guy by helping all the "newbies" out. Serge, have you made a deal with Acacia yet? Whats laughable is that you mistakenly believe you are a 'big player'. AOL Time Warner and News Corporation are the big players, not you. You'll find yourself squeezed out with the rest of them once these guys squash the entire porn-at-home business. |

First off, I did not mention CE nor did I infer them. Second off, if you actually think that CE signed Acacia's documents you are a fool. CE spent money to have their attorneys come up with a document that suited them as well as Acacia, and while I certainly haven't seen the agreement I seem to recall FM saying on this board that if the patent were invalidated he would not have to pay under the terms of his agreement with them. |

one doesn't need a lawer... file in small claims court for maximum amount allowed by court, repeat it 2000 times all over the globe at cost of $7.95 a pop. JMM, I haven't "killed the cohen's gragon" thinking inside the box, and neither should you. As for coming to Orange county- this is incorrect too! |
A lot of sense it makes for someone to come in here and publicly dispute the IMPA http:///www.impai.org
Talk about divide and conquer. Rather than debating these guys...how about trying to help 'em out? |

I will not waste my time on you, find yourself another thread, as always, I preffer talking with adults, not children |
Hey Kimmy, When I ask you if you are a idiot then you have the right to ask me if I am stupid.
My question held no disrespect for you and what you may or may not know. I was posing the question. If you happen to know that CE drew up a new contract then sharing is nice, but why use the attitude?? I have never been rude to you. |
Greetings:
Serge: you make a good point. If you have the time to tell me: I live in Canada. I have not yet heard of them coming here to bother us. You speak in your initial rant (" ...you ARE pathetic ..") of "all over the globe." Can I then safely assume I can just file it based on the bullshit I see happening there and can present evidence from another country's ongoings? And I agree on your big business attitude. I will agree more when I am big business. :glugglug I have posted somewhere in these threads on acacia about what I see and wish to do to deal with the situation...in my mind it seems easy enough to proxy controls from somewhere else and still retain total content control. Cheers, /Allister |

don't look at my post as a blue print, but rather as a "thought provoking post" urging everybody to think out of the box, that's all. |
Serge
You make a good point! A lot of the webmasters here don't have thousands of $$$ to spend on legal advice and just want to get on with their lives making a few bucks. They already have enough problems to contend with, without this ACACIA shit adding to the almost daily announcements from one or more processors. Your idea of sending in numerous small claims makes a lot of sense but obviously world not be claims against the patent, more along the lines suggested. Unfair business practice, Extortion, Blackmail etc. etc. Someone might have to get a legal opinion as to what can justifiably be claimed so that it just doesn't get thrown out, but with laws in the USA i am sure there are many avenues one can explore. This may very well not have any impact on the patent but i am dame sure it will impact their resources which are already under strain. Lets all spend $10.00 and send in as many small claims as possible, my company has offices in 6 countries and i will get them all to start sending in claims to-day. If you all do just one i am sure it will help put these fools out of business. After all if no one signs up to pay them their extortion money and their funds are being depleted at the present rate 4 months should see them go bankrupt ?? Cindy xx :2 cents: |
Gotcha:
I was going to thank you for at least pointing me in the right direction - at least I have the right words to use when I ask few of my friends who really know the legal world. (Are able to use it to advantage in any case ;) Cheers |
I did not infer that you said something negative about CE...
If I did, show me where! |
