Taking this to the board: Luxi Thai model
 

I am a customer of Paul Markham. I purchased some photos of a model named Luxi from his site.



This model is Luxi who operates a site of her own has been contacting my link trades and telling them I stole her images. I provided documentation to anyone who asked and she is further harrassing me and them because I am using the name Luxi on my website and also on my toplists such as PickaAsian.

Paul has written her but she insists that the release does not give anyone license to use her name. Paul sells the sets under the name Luxi. I can post the license if anyone wants to see.


Her harrassment is based on the fact that I am stealing traffic
from her on toplists and stealing her business. She is demanding that my traffic partners remove the 'fake' luxi and only allow traffic to the original model.

The emails I'm getting are threating harm.

She claimed she has Luxi and Luxionline trademarked.
We were not able to find these in the TESS and the UK trademark database. Her husband has now joined in stating that he has purchased an international trademark for these names.



There are many Luxi sites on Google, she is not interested in pursuing anything more than having me remove my sites and is not concerned about these other sites.


A few Gfy folks have been privy to this and suggessted I take this to the boards as the situtation is escalating.

This is a real problem for webmasters who purchase legal content from reputable providers and their attempt to hinder our business. Not to mention slander and phsycial threats are serious.

Even if she has trademarked that name doesn't mean you are infringing on it cos it is her original photos of "trademarked item" if you have the model release/license. And she could ofcourse only beat you up if she knew your wehereabout and lived in the same city is about it :winkwink: Otherwise, just tell her to take it to court. I highly doubt she will thou or you'd have already been served with atleast a letter from her lawyer. For instance, Cameron Diaz is a TM yet even she has to pay a photographer 4 mil to get a model release withdrawn.

Will have to chaeck out the model release we have from this girl but I do not see her excluding any names on it so I doubt if she has a leg to stand on.

Maybe everyone takeing the sets from us for a give away price and posting them all over the net might make her sit up and take note.

The problem is she can make problems without any consequences as she is in the UK. I have tried to contact the photographer but he's away from his phone, Eva send him a link to this story.

Law suits are easy to draw up...... much harder to win them in a court. Call her bluff and see what she does. I had a similar incident with a girl named Lucia Tovar. She wanted me to get her work and told me to go to her personal site and use the pics from there. Well her webmaster had a fit about it because he wanted to have the only Topless pics of her anywhere. I lined her up with some work and the dipshit did everything he could to keep her from shooting. Poor girl was being pulled in too many directions so I just took her off my site and bagged getting her jobs. once she is too old she will realize that those guys arent looking out for her at all. Just themselfs and their site.........
