Webmasters In Thailand
 

Does anyone know how you stand with the law when publishing pornography to the net from Thailand.

According to the Bangkok post the government has recently issued a statement that it will start clamping down these activities.

I indirectly publish to the net via two friends in Thai and have some 20 domain names registered there but neither of these guys is sure about how they stand with the laws.
I will seek legal advice on my next visit but in the meantime does anyone know where the line is drawn. Thai law be very confusing at the best of times.

I also take a Jungle tour and i will be 1 week in Bankok the hotel in Bankok i cant remember tough

The article appeared in my BP newsletter sometime last month and was in the current issues. The search date might be fucked up.

I have word that things have happened but they might be just rumours.

hmm....okaj, we are thinking of moving shop too, to somewhere warmer and lower taxes than were we are now....

We were looking at Philippines or Thailand, but if this is correct, Thailand is out of the question....

Anybody got good ideas about wheere to move, where u can get english speaking employees, warm weahter and low taxes ?

Thai law example -

In Feb this year I got stopped by police for having 3 people on motorbike and no helmet - paid find in police box and was then allowed to continued journey with 3 people on bike and no helmet.

if their law is like their traffic then you're fucked

i own a home down in Phuket and spend a good period of each year in Thailand, and do have a thai lawyer on call (i had to get one to buy my house in the first place, kept him on due to the nature of my business)... if anyone can line up some specific questions i will definitely touch base w/ him and see what he has to say on the subject.

in the past he has told me that the only thing thai authorities will bust you on is the actual production and dissemination of pornography, and that as long as i only used the internet for administrative purposes and was not *uploading* obscene/hardcore media from thailand to the web there was nothing to be concerned about. last year an australian couple was caught producing porn in the town where my house is (Patong, Phuket) and they were indeed producing pornography in their rented room for internet distribution... they were culling young ladies from Soi Bangla and were eventually caught due to 'word of mouth'... they both received sentences of 10 years in a thai prison (probably at the large prison facility NE of Bangkok in Korat), and were *not* deported as many seem to think is the result of expat's and tourists breaking thai law... be careful slinging the pr0n in the land of smiles!

again, if any can supply me w/ a short list of reasonable and thought-out queries i will make sure to get answers for them from my thai lawyer..

thai internal airlines are by far safer than most american airlines

on the other hand i would advise anyone to avoid the buses in thailand

Thats not racist its the fear of flying on small aircraft. I have not use Thai buses but there have been scary moments in Taxis.

That is very close to what a Thai real estate lawyer told me on the phone but as its not his field urged me to find a specialist.

Reading your stuff tells me -

You cannot produce or distribute pornography in Thailand.
You cannot upload obscene/hardcore material from Thailand.

If both of these are true then you cannot legally be an adult webmaster in Thailand unless you are just administering the areas that don?t involve handling adult material.

With this in mind there remains only one question.

What material is acceptable if any? Or like the UK for example, is there a fairly clear dividing line between hard and soft-core porn.

Yeah..I was there on christmas two years ago, but it wasn't anything near that pic..I spent my time with my family though.

as far as the laws on porn in thailand, yes, you were off kilter quoting a 4 year old story, hehe as far as i know 4 years ago sex with 13yo girls in thailand was still allowed, now its very illegal and verrrry rarely found, no more than the usa.....

it *is* illegal to shoot content here, if they crack down, you will go to jail... albeit i see many many porn sites with live thai cams, and new photoshoots of all of the bargirls that are very recently and updated daily and whom make themselves known locally here they do what they do... and they are operating fine.... as stupid as it may be....

operating a non-thai porn site from within thailand you'd have little or no risk.... if you make more than 2k per month (and who doesnt??) in porn it would be wisest to hire someone abrpoad to run your porn sector for you.... even better yet, sell your tgps to Buffet, and start running mainstream generic viagra sales instead =))

i have alot of friends that do work there , i will not not say who tho , kman is one but he post here , and to tell you it isnt safe there , one thing there you not trust a thai , they will nail you . i have a friend that had probs there ,
alot of sites are even blocked there , so it can make hard to do work

you need to hide al the ways so you cant and want get fucked it ,
they can have alot of probs over it , if they are not thai they cannt be made to leave , if they are thai they can go to jail .

ya there is alot of guys making content there ,you have to be very safe there , or paying off alot of people ,

the police there pay people to tell them who is making content there and running sites , y ? they go to that person and bust them and then it is pay off time and can get costly

i go there alot , and nice place a 100 times better the PI ,
lot there to do , and has some great beachs there as well

this is just my :2 cents:
they need to cover tracks and be safe , and make sure they not reg those names there , can make another big prob ,
