speeding ticket out of state

I'm driving in upstate NY, trying to figure where i'm going, looking around, and I get pulled over out of nowhere. The cop told me I was doing 53 in a 35, I get the ticket, he writes it out for 53 in a 30.

Now I have never received a ticket before, been driving for years now, apparently the 6 lane highway I was on was fucking 30 MPH or 35 MPH, I still don't even know, and he pulled me over like 3 minutes after I was even on that road (I'm guessing there are fucking cameras everywhere).

The guy wouldn't let me off even though it was the first time I was ever speeding, he said everything is recorded.

I live in NJ, I was just in NY for a business meeting. Will my insurance company find out about the ticket and will it have any affect - never gotten a speeding ticket before...

Fucking NYPD, i have respect for the ones who work in the tough neighborhoods, but the ones in the suburbs can go fuck themselves!! :321GFY :321GFY :321GFY

the question is, will it be points on my license since it is out of state.

More then likely your insurance company will not know anything about the ticket.

They really dont have any reason to run a check unless..

A. you are making changes to your policy

B. Start a new policy

Keep paying your premium like a good soldier and they probably will never know a thing

Most companies do random checks. Don't tell them but don't be surprised if they find out.

Depends on your insurance company. Mine only checks for out of state tickets if you add a new vehicle or upgrade a policy. In state tickets get added in a month or so. Only reason I know this is because of the Ohio State Police and their love of Michigan license plates. lol Probably depends on state laws too now that I think of it.

Sure they do random.. but it costs them $$ for every check. So I imagine its VERY random.

So random in fact I had a friend get a DWI and his insurance never knew a damn thing

go back check the speed on the street and fight it if was written wrong. it should be tossed out

Biggy2 07-14-2003 01:34 PM

im glad to hear, I just recently added a vehicle, got a new car this past week and it was in this car I received the ticket..

So im hoping since ive been insured for a week already, plus it takes time im sure to file it since it was out of state, maybe the timing couldnt be better....

now, if it happened 2 weeks ago before I got the new policy, then maybe it would be a cause for concern, but considering the policy was recently added, and i've already started paying...

its an hour and a half away, but im pretty sure.

the first thing the cop told me was "tarrytown road is posteed 35 MPH, you were doing 53 MPH".. then i checked the summons and he wrote it for 30 MPH.

If you already got your policy I really wouldnt sweat it.

Just dont go making changes to your policy for a year or so

wtf does nypd have to do with anything in upstate??? You will get 2 points on your NJ license for any out of state tickets... The points will drop in 18 months...

pornguy 07-14-2003 02:18 PM

Do NOT pay the fine...

Go to COURT!!!

you have a 50/50 chance of winning, by the cop not showing in court, there for the citation is dismissed for lack of prosecution, if he does show up just say no contest and 90% of the time the judge witholds the points on your license and sends you to traffic school...

If you dont believe me go to court tomorrow and watch some traffic cases...

You *really* need to call that cops station and find out something... some states don't add points on multi-lane roads if you were doing under 20mph OVER the limit (19 or less)... So if the cop wrote it for 30mph and it was actually a 35 mph zone, then you got the points... but if the NY law is one that overlooks the under 20 thing, then don't let them get you on points.

And don't be real surprised to have your insurance dropped. If they call and 'ask' tell them the truth or your guilty of attempt to defraud an insurance company and they are reallll serious about that anymore. They check that alot more often then you think. They pay a monthly fee in most states to access, not a per access fee.

Tell them upfront and the reason WHY you got the ticket and you would get off with a small increase (or maybe nothing since you weer in unfamiliar territory and it was your first time)

I got one in Indiana once and I lived in Missouri at time. I paid ticket and forgot about ticket on insurance applications. :) Rates didn't go up.

I'm gonna go fight it, now that I think of it, he acted polite but now im thinking he was an asshole. He specifically told me it was 35, and wrote it out for 30, so if it turns out that it was 35, then I think he did it on purpose. That leaves me with the feeling that maybe he inflated my speeding as well, to 53 from 48-50, etc. After that, I told him I never even saw any signs (i'm pretty observant about that type of stuff), he promptly responded that there were 3 coming down the road, I just thought the answer was a little too quick, since I was only on the road for a half mile... He ended up pulling me over on a completely different road, I had to ask him where this other road was..., and I really feel like he could've given me a warnign. He fucking knew I was out of town and not familiar with the roads..

Either way, if I find out the speed limit was 35, i think something is off, since he specifically told me it was 35. If it turns out it is 30, then I'll know he was honest..

Yea, what someone said back there is true. Go to court, and if the cop did not show up, you get off.

I don't know if this helps, but I was caught running a red light(tecnically yellow but red when I was underneath), and the cop gave me a warning, since I have one of those "support state trooper" sticker on the back of my car.

Also, if you have money, you can never get a speeding ticket. My sister went 95 on a 55 highway once. She was so scared of the increasing insurance premium, she paid a lawyer, and got off scott free. Oh, what money can do for the system.:2 cents:

Thats called deferred judication. It only works as long as you dont get another ticket for 90 days afterwards.

I have money, i just dont think its worth it - i think i got lucky that it was out of state, and if I go fight it, and cut a deal with the prosecutor, i'll hope he gives me zero points, and reduces it..

My father used to do community work, and through it knew the local police chief. The police chief gave him a special card - it wasnt a PBA card, you cant buy this card, you have to know a policeman high up (my town is ~30k strong). For years my dad got pulled over at least 2 times a year, and never got a ticket, not even a warning.

It also worked out of state, he was in NYC, got pulled over with 3 other cars in a speed trap, my dad showed him the card, the officer told him to keep it below the window, and let him off while giving the others tickets...

it really was a get out of jail free card.
