acting or prostitution?
A possible biz partner has brought up a concern which he thinks is a grey area in the law.
When you pay ir even if you don't pay someone for acting (i refer it to acting) in a porn movie or in pictures can it not be considered prostitution? I said no, because you are paying them to act/model and not to have sex. However he said it could be said otherwise. Maybe my general model release form is too general but uh. i guess it should specifiy that? Even though it says we shall be held harmless etc etc and they should back us up He is concerned if some locals find out and start shit like we are running a prostitution ring ir some BS which he aren't it could seriously do some PR damage because we also have other jobs in the community which are reputation is depending upon. I could use some thoughts, I will recommend we use his lawyer for advice (hah he can pay for it) But still i'd like some thoughts on this |
the act of filming sex doesnt make it not prostitution. However, the act of paying for sex is prostitution. Let me go look up the supreme court rulling, brb.

it falls under artistic freedom of expression. you are paying to have actors act a part with a production crew, this is not a personal exchange of money for personal pleasure.

It's legal until your local authorities say otherwise. If they decide what you are doing counts as obscenity, then they can put a stop to it. Temporarily.
But you would most likely win in court due to precedent and similar first amendment trials. These days it would be hard to prove that porn is obsenity unless you live in a community where no porn magazines are sold, no videos are rented, and there are no strip clubs. Then I'd be scared. |
well trying they tried to close down the strip club but they can't so they are going to control how it operates. hah. now i'm scared lol
But you can rent porn movies in different places. and you can buy porn mags in many stores. now i'm feeling safer. Basically i plan on being discreet but i will consult a lawyer. |
