Anyway my original question was if anyone knows if FLASH "movies" would be covered by their patents?... since it's not really "video"....

It's a great question, actually. Since you import the "patented" technology into the .fla and export Macromedias proprietary .swf file, it may be a loophole.

Too bad the video codec used by Flash does a fairly poor job of rendering video, though.

I bet that patent is broad enough to cover a animated gif if there were enough frames.
