Actualy, yes I am to an extent. I somehow lost my layers and was unable to get it back

Just tried doing that for fun and I got it back

1) undock it.
2) open an image and screen cap and post your whole screen. Maybe there is something someplace else on your screen that may be causing the problem.

If I don't have a document open I see the same thing you see. Except, mine isn't docked up on top, it's lower on the page I guess in the default area.

What I think hapened is I hit the wrong ctrl+ shortcut and it caused it to dock up top. It's all ok now though.
