How do you guys handle people who steal your work?

I have found several websites that are using our work (Oliver-Klozov.com) without our knowledge and/or permission. I would like to go ahead and bill them for usage up to this point and then demand removal of the images from their websites.

Is this legal?

Actually, if I were you I would take advantage of the situation instead. Odds are, the sites are just some silly little babe sites that aren't making anyone any money. Why not tell them they can make some nice cash AND continue to use your pictures by joining your affiliate program?

Contact the host...DMCA 'em through your attorney.

That is a pretty wicked idea...although some will argue you are condoning theft in a way by rewarding the guy instead of punishing him for stealing your original work.

Would you want a known thief joining your program?

Oliver has babe sites. Tons of babe sites have no idea what they're doing and just post pictures of hot babes to show their friends and other people interested in babe sites. Many of them aren't stealing for profit, just pure enjoyment. Tell them they can make some extra cash and continue to enjoy themselves, what do you think their response will be?

I wouldn't go after these "content traders" anymore than I would go after "music traders". Twist the bad situation into a good situation, making you both money.

The first thing I do when I can intiate contact with the webmaster is inform him of the infringement and point him to some laws that let him know what he is and isn't allowed to do regarding content and posting it.


Then let him know he can purchase it, giving him the benefit of the doubt, and hopefully close the deal and have a new happy customer.

If he doesn't reply. I get his server jacked.

Took me 10 months to get copyright for a site from the library of congress. The illegal sites are usually long gone by then.

You dont need godaddy to do it. You can do it yourself easily for half that amount.

It may have taken you 10 months to get the actual certificate back from the copyright office however, under the law, the content is considered registered the day the copyright office receives the registration form and check. If you take a look at your registration certificate you will see that the date of registration is the day that they receive it, not the day they send you the certificate 10 months later.

If you don't have a certificate claiming ownership, how do you know you own the copyright, let alone go after someone for it?

I would assume that you know what you own, that is how you know. To go after someone, the certificate would only come in to play if they are challenging your ownership. You can show them, as proof, the release, original images, model affadavit, etc, etc, etc.

If you filed suit the day you sent in the paperwork, chances are it wouldn't get to court before you got the cert back anyway. Registration is required to file suit and also for maximum damages. The registration date, by law, is the date they receive it. The courts, and lawyers, understand this.

I will write to them and let them know about the infraction, give them the opportunity to make it right... Also give them the opportunity to pay you if they want to keep using it...

If that does not work, a formal letter from your attorney is always good..

If that does not work.... sue the bastards...

I have had that happen to me, but they took it down right away after I contacted them... Actually, it is best to do it by phone on the first contact... Sometimes words read different than they were meant.... People misunderstand me all the time... but then again... I am not a people person... I am a computer geek lol.

we've had people steal our video content...it's tough to stop (and somewhat expensive) let me know if you need a good attorney that deals with the adult industry...

If other people would do the right thing by content producers, who face it are the backbone of the porn biz online and off, all the thievery would stop - i mean thievery by professional adult webmasters, not worth going after file traders and hobbyists, Hollywood is literally throwing billions at that with little success.

If the processing companies. affiliate programs. TGPs,would kick out known content thieves it would go a long way.

Can California attorneys work on a contingency basis in copyright cases? Cuz it's the upfront money that stops alot of smaller companies from going the legal route against thieves.

Movies are now the hot item on the adult Net now, guys who shoot movies custom or licensed should be literally shooting 24/7 to meet the demand - but take a look around at the MGPs and the movie paysites - if 20% of it is licensed legally that would be alot.

I inform them then there sponsor and if that fails APIC.

Using a hammer to smash a pea usually gets the results. I know this will now get you flaming me, but who wants the "nice" approach when that has failed.

I think the problem with content theft is more than just black and white. Most content get stolen from TGP's. One could argue that if you put you content out there for free you are at fault that some people are using it also. Don't get me wrong here I will not condone professional content thieves but if you make it thieves that easy can you really complain?

The other thing you have to ask yourself is:
Do you ONLY use bought and licenced software? I seriously doubt it.
DO you download music or movies from the internet? Most do

It is the same thing and if you use any software that is copied or ever downloaded a song you should not really whine about content theft
