Why can't the thumb preview idea be patented?
I mean the idea of thumb preview of galleries not the idea of thumb preview of the pictures inside galleries. I think it was a big improvement to adult sites and I am wondering why that idea is not patented.

Anything can be patented these days, but you would likely spend more money trying to enforce it than you could make on it.

supposedly they violated two patents, one was for fixed price auctions.
patents are handy for dealing with big fucking companies that want to mow your ass like grass, but they're basically the wrong idea. waiting 70 years after the owner's (not the author, but whatever corporation or individuals buys the legal right to the patent) death was never the intention of copyright. in software it kills heuristic innovation outright.
