In a civil case you'd always have to disprove existing written evidence (if headers were forged, etc). Take a look at what happened to Gary Kremen, it's obviously harder nowadays to forge any type of important documents, but for example if you were suing someone for threats/slander/libel via e-mail and they felt the mails were forged, they'd have to prove it, not the other way around.
