Shooting content in Canada.. HELP!

Me and my buddies are getting ready to start shooting content for a Reality site we have coming out.. Can anybody point me in the right direction to some rules that we must follow so we don't end up in jail? We did a shoot this weekend and the girls we're giving us some of the rules..haha..

Peace

Recipe for an arrest warrant.

Perhaps you should have asked the girls to set their own pay rates too.

There are no rules. Just do whatever you think will sell.

Just let them walk around topless in public and film that. Apparently that's legal for them to do now.

I have yet to see a girl with double D's do that though.

Martin,

Why would you ever leave yourself open to legal action by shooting first BEFORE knowing anything about the legality of such things?

I don't shoot content so I have no advice to give, except that talking to a lawyer first is never a bad thing. Especially if you're unsure about what's legal and what isn't.

Martin 06-09-2003 01:34 PM

Well we didn't do anything too serious.. We just a little bit of fun with them.. I'm talking about for the "Reality" stuff we're going to be doing..

Talk to a real lawyer.

bigdog 06-09-2003 03:09 PM

why not get someone else to shoot the content for you so you can work on other things like marketing and sales

They will search you at the border, so if you are shooting film I'd suggest fedex. If it's digital, upload it before you leave for the border. About half the times I've gone over the border they've searched the vehicle. On your way over there..they will ask you what you are bringing along...if you say you have a computer, they will search your car. I know of a case where they held porn at the border until the owner could produce documentation proving the models were of age, but that was going INTO Canada. Canada has nude beaches up around Montreal..if you are doing outside stuff..you might want to consider hitting a nude beach. They are a lot more liberal, but still cover your ass in every way possible. Also, if anyone of your party has a DWI conviction OR any felony conviction they may have a problem getting across..especially if they stop you for a search.

NO, it depends entirely on the context that it's taking place in. Canadian laws are very subject to interpretation, however, there are some laws that are VERY firm and only have one interpretation.. I've literally spent years researching, consulting my and other lawyers, etc and I have a pretty good handle on canadian obscenity laws etc. Bondage is acceptable if the following considerations are met.

The person must look like they have SOME degree of mobility and the ability to escape in an emergency. Don't ask me why I don't write the law. There can be absolutely NO FORM OF PENETRATION WHATSOEVER if someone is tied up or restrained in any fashion. Even a fingertip and it makes it illegal.

There can be NO BLOOD or ANY indication of pain or humiliation of ANY SORT (as in the model showing pain etc), or this renders the material illegal. That kind of stuff. I have a bunch of other sources of Canadian law. Here are a few resources.

Those might help a bit.
