Ok now this lawsuit is a bit overkill
|
LOL, that's a good one.
"Now this trick is called the Anal Invader 9" Fakey". SpaceAce |
"loss of enjoyment of life":1orglaugh

The suit seeks unspecified damages for his suffering, emotional pain, medical costs for therapy, loss of enjoyment of life, loss of earnings and earning capacity, special damages, general damages, and punitive and exemplary damages.

The magazine was purchased in Utah.
That's all you need to know. A Utah jury is going to make this kid a millionaire. |
I disagree with you. A 12 year just watched a porn video. In case no one understands this concept, it's against the law for 12 years to be given access to porn. More so in Utah.
|
How the fuck do you mix up gay porn with an inline skating DVD?
|
They should sue, i dont want my son buying a skate mag and getting a porn dvd, gay or straight.

if your a content provider and sending out cd's.. or sending any porn thru email.. gotta make sure it's to the right house or some fucker will pull that shit on you |
"mail" not email
|
Not only would I be unfuriated if you mixed up my kid's sponge bob dvd with pornography (same difference here really)
But the fact that they were "laughed off" when they complained to Barnes and Nobles would just add gas to the fire. In my case they'd be suing me for beating the shit out of the person who laughed when I complained. |
Maybe I'm just a skeptic and a realist..
I laughed when I heard the story, first thing i thought was yea right I can immagine some clerk at the store doing the same. Why sue Barnes and Nobles anyway and not the publisher (cause B&N more than likely has more money than the publisher) CD's usualy come sealed in a bag (the ones with magizines), how in the world could B&N be responsable Then to sue for "loss of earnings and earning capacity" he's 12... How the hell do you pull that off... |
Americans are out of their mind.
The sad part is that more and more people in Holland are going the American way and start to sue people for nonsense like the story above. Sad, very sad. |
Wouldn't the kid notice the video saying you must be 18 or older to view...I'm sure it displayed that before the dvd started...
But still besides the point...But it is definately a laugh for the damages. Jon |

Sounds like a fairly good case to me. Good enough to make B&N settle for a good chunk of change (couple 100K?). I doubt it will actually go to trial.
But, who actually put the wrong DVD in the magazine? It sounds like the magazine producer. So, the parents are just going after B&N for some deep pockets action (probably through a UCC retailer of defective good claim). |

Couldnt agree with you more, although I cant help to think about the time I woke up to find my 5 year old glued to the porn channel. |
