Not saying that what that guy did was right...I would be pissed off if it was my site he copied. But is that illegal? Always wondered as that has happened to us many many times in the past.....

Its more an annoyance then anything really, Specially when you build up a reputation for a simple gallery design that gets accepted everywhere, say this guy that copied his design cheats the system or does something else, it sort of reflects on Quiets galleries in the future, even though he never did anything wrong, it will always leave a bad taste.

Usually in these situations, a simple email from the rightful owner can clear up the situation.

the things that make quiet's gallery to perform great are so obvious and still webmasters fail to see them. You could bring pretty good results by studying the logic behind the gallery than copying.

Studying? Are you stupid or something, that would require thought. Why not just copy the layout directly and disregard everything else, much easier.
