If I buy exclusive content, can I resell it?
just wondering if anybody does that..
|
read the contract
|
Sure why not.
Annuonce it here on GFY when you are ready. (also let me know who you bought it from so i can tell him before I get the popcorn ready) |
if we shoot it exclusive for you then yes you can do what ever you want with it.

It totally depends on the content provider. Seriously, do not do that if you are not expressly given permission to do it in your license. You can always email and request additional rights for reselling and if the photog likes you, they may allow it like fantasycontent said above.
|
depends on the deal u cut with whoever shoots it for you, 'exclusive' has different meanings to different people.
when you buy from me, you do own the content, lock stock and barrell. Only people we won't shoot for are content resellers but if a customer wants to sell his content to a couple of webmasters that's ok. |
supposedly with a custom content shoot you are BUYING ALL RIGHTS because it is shot FOR YOU. so it shouldnt be a problem, and anyone not selling you ALL RIGHTS is not someone that i would want shooting me custom content.
|
that is the only way we sel our content is exclusive and that give`s you full rights to it to do as you wish with it and that does also give you selling rights and they are yours for life time as well :thumbsup
|
yeah you should be able to do whatever you want with it :)
99.9% of the time. i have exclusive web rights on some content but i can't repackage and sell dvd's etc. which works out great because i can get the content a lot cheaper. |
exclusive or custom does not necessarily mean you're getting re-seller rights. It would definitely have to be clarified in a contract with the provider.
as far as I'm concerned "exclusive" means just that and nothing more. you cannot re-sell the content. for you to actually "own" the content or images you would have to have documented proof that the author/creator of the material has transferred all copyright on the material to the buyer. to go a little further, if you do re-sell the material, and are not the actual producer who is responsible for the 2257 recordkeeping, can anyone answer this.. possibly some content brokers that deal with a lot of different producers. I don't deal with brokers but as far as I understand before they will sell any photographer's content , a re-seller agreement has to be signed. |
you're interpretation is right, if that is all that is agreed to when u make the deal, you are providing the customer with 'exclusive' content, they do NOT have total ownership and rights to do whatever they want with it i.e. book publishing, resell, DVD, leased plugin
got some new pix for me Candido? :Graucho |
