Law suit against file sharing companies...

..... and certain tubes and websites promoting stolen content and possibly including VISA and MC maybe even Google... since ALL are participating in these activities without any oversight.

They ban you if you place on your website something "iffy", but let thse fuckers profit from thievery, not to mention scat, zoofilia and kiddie porn. Time to show them that their paper castles are really made of paper !!

Many of us are fighting many pirates but NOBODY managed to stop them. What about getting toghether and charge these bastards under RICO ( Racketeer Influenced and Corrupt Organizations Act ) statutes. RICO has federal prison sentences 5 years or more and huge fines.

Namely section 2318 of RICO

Quote:

relating to trafficking in counterfeit copies of motion pictures or other audiovisual works
section 2319

Quote:

relating to criminal infringement of a copyright
...and since most of these skunks do not adhere to 2257 ( I say fuck them, they have been informed) and are sending money to the pirates, maybe also adding sections

Quote:

section 1960 (relating to illegal money transmitters), sections 2251, 2251A, 2252, and 2260 (relating to sexual exploitation of children),
With the current atmosphere in US it may be quite easy to find a DA to take this on and since this is a federal statute "one hit will kill all".

I am willing to throw in 1000 dollars, so we need another 10 maybe 15 webmasters to join to get this going and go for $ 100,000,000 in damages. Divide it up by 10 or 15 and retire :thumbsup

Anyone has any comments or suggestions ??

Start by finding several program owners who are based in the United States and ideally they are pushing mainstream/vanilla products or services.

IMHO a US District Attorney will not fight on behalf of any foreign entity, let alone a peddler of porn.

Nonetheless good luck. I sincerely hope you are able to move forward.

Many of the sites have " mainstream" content ( ehm erotic thrillers) horrors, soft models etc... so just need to be judicious ...Somebody like wipfilms.net ( and fileboom) have mainly Holywood movies.

As I have said, just testing the waters...it is all about : " purveyors of porn" mainly the file sharing sites...

Wait for Hollywood to do it, if they don't porn won't.

brassmonkey 07-10-2019 02:09 PM

they will never be caught.

NOT so....

Here is a reply to one of mine DMCA take down notice:

Quote:

Hello,
We have received your abuse complaint and our Abuse Department has looked into the situation.
Unfortunately, we are unable to process your request because of the following reasons:
Please communicate us the links to our website. We can't handle links which do not contain the correct links to the infringing files!
then I have replied adding this bit into the text:

Quote:

I am pretty sure that you are aware of these illegal activities, but if you are NOT, then consider this also as a notice of these facts as all participants may be charged and convicted under Racketeer Influenced and Corrupt Organizations Act ( RICO) statutes. Specifically section 2318 (relating to trafficking in counterfeit copies of motion pictures or other audiovisual works) and section 2319 (relating to criminal infringement of a copyright). Since money are changing hands maybe also under section 1960 (relating to illegal money transmitters).
less then hour later I got this:

Quote:

Hello,
Thank you for your report.
Specified files that were reported are deleted.
So, maybe nobody tried it before :thumbsup

or maybe you just didn't file a proper DMCA form that included the links to what you wanted to have taken down. It seems they had to guess what content you were alluding to.

Either way, good luck with your lawsuit.

Malibu Media LLC (aka X-Art) has had success going after torrent users.

Quietly, the Fields were also making some extra money in another way: by becoming the biggest filer of copyright-infringement lawsuits in the nation. In the past year, their company Malibu Media LLC has filed more than thirteen hundred copyright-infringement lawsuits—more of these cases than anyone else, accounting for a third of all U.S. copyright litigation during that time, according to the federal-litigation database Pacer—against people that they accuse of stealing their films on the Internet.

This is a 5 year old article, so who knows what is going on with X art today. Good read nevertheless.

As I said, "has been". If you want to see if Malibu Media LLC is still actively pursuing pirates, then go to PACER.

Believe it or not after failing to get rid of this pirate ( he was NOT reacting to e mails) and all of the runaround from his proxy server in San Francisco, I managed to get to the main server in Russia ( the registrar gave me an abuse e mail). I did send the server a notice and my comment on RICO and voila.. two days later I got this:

Hello,

Hoster suspended this site because owner do not response within given time limit.

Best Regards
The reason I did ask you members here to check is because of the 403 code. I thought they may have just banned my access via some trick with IPs. Obviously they dumped the whole site :thumbsup:thumbsup

Way to go Vladimir :1orglaugh:thumbsup and as for the pirates?? RICO is coming for you so :321GFY:321GFY

Btw, what gave you idea to use that law? I see that law is in action since 1970 hence asking.

In short....? "Desperation" being really fucked by many pirates.Somebody said about me years ago:" when you see him looking like a farmer Joe with a straw in his teeth watch out the trap is about to spring on you"....

Be that as it may, I went a googled how the Government dealt with Mafia and was successful.
RICO popped up. The rest is just " straw in my teeth". Of course RICO was introduced even before fax machines and was not yet tested in case of modern Internet movie piracy. Why not ? I do not know. I guess it would kill the lawyers " golden goose" jobs, selling us DMCA services, and why go after the big wigs when we can scare some old guy who loooked at stolen porn in paying them couple of grand ....but doing it 1000 x over and over.

Here are a tidbit from past case law ( maybe some lawyer from here can chime in)

Quote:

In Sedima, S.P.R.L. v. Imrex Co. (1985), the U.S. Supreme Court concluded that RICO is not limited to organized crime but may be applied to legitimate commercial-enterprise businesses.
Anyway regardless if it works or not it seem to get an attention even from such " we know nothing" oufits likes of CloudFlare...

So moving on :2 cents:
